【摘要】：[目的/意義]美國1978年頒布的《涉外情報監(jiān)控法》建立了涉外情報監(jiān)控法院制度,但因該制度存在諸多問題難以發(fā)揮制約情報監(jiān)控權(quán)的功能。如何改革該制度以平衡國家安全和公民權(quán)利保障遂成為美國涉外情報監(jiān)控制度亟待解決的問題。[方法/過程]運(yùn)用文獻(xiàn)研究、歷史研究、規(guī)范分析等方法,分析涉外情報監(jiān)控法院制度的建立、發(fā)展和社會各界對該制度的批評及回應(yīng)。[結(jié)果/結(jié)論]研究表明,該制度存在缺乏對抗性、秘密性、法官選任不合理和缺少必要知識信息等問題。2015年《自由法案》雖力圖通過改革解決上述問題,但結(jié)果不盡人意,進(jìn)一步改革的呼聲不斷。美國涉外情報監(jiān)控法院制度的經(jīng)驗教訓(xùn)對我國相關(guān)制度的改革有所裨益。
[Abstract]:[Objective / significance] the Foreign Intelligence Monitoring Act promulgated in 1978 in the United States established the court system of foreign intelligence monitoring and control. However, it is difficult to exert the function of restricting the right of intelligence monitoring because of many problems in this system. How to reform the system to balance national security and civil rights has become an urgent problem to be solved in the foreign intelligence monitoring system of the United States. [Methods / process] by means of literature research, historical research and normative analysis, this paper analyzes the establishment and development of the foreign intelligence monitoring court system and the criticism and response to the system from all walks of life. [Results / conclusion] the study shows that the system lacks antagonism and secrecy. In 2015, the Freedom Act tried to solve these problems through reform, but the results were unsatisfactory. The experience and lessons of the foreign intelligence surveillance court system in the United States are beneficial to the reform of the relevant system in China.
