【摘要】：互聯(lián)網(wǎng)技術(shù)的發(fā)展為我們創(chuàng)造了廣闊的信息溝通平臺(tái),使人的活動(dòng)空間從物理領(lǐng)域延伸到無(wú)形的互聯(lián)網(wǎng)空間中。為了更好的解決民事執(zhí)行難、執(zhí)行亂等問(wèn)題,我國(guó)法院逐漸嘗試將互聯(lián)網(wǎng)技術(shù)使用到民事執(zhí)行過(guò)程中。在其探索的過(guò)程中,互聯(lián)網(wǎng)環(huán)境下的民事執(zhí)行也面臨諸多的難題。本文將落腳點(diǎn)主要是針對(duì)互聯(lián)網(wǎng)環(huán)境下我國(guó)民事執(zhí)行存在的問(wèn)題,聯(lián)系我國(guó)現(xiàn)行民事執(zhí)行機(jī)制的實(shí)際現(xiàn)狀,為完善互聯(lián)網(wǎng)環(huán)境下我國(guó)民事執(zhí)行機(jī)制的適用提出建議。本文總共分為五個(gè)章節(jié):第一章為引言部分,我國(guó)法院對(duì)互聯(lián)網(wǎng)環(huán)境下的民事執(zhí)行機(jī)制的探索尚處于初級(jí)階段,面臨著諸多問(wèn)題。本文將重點(diǎn)放在分析互聯(lián)網(wǎng)環(huán)境下民事執(zhí)行機(jī)制面臨的問(wèn)題,以及針對(duì)這些問(wèn)題給出合理的建議。第二章主要是闡述互聯(lián)網(wǎng)給我國(guó)民事執(zhí)行帶來(lái)積極影響和沖擊。在積極影響方面,互聯(lián)網(wǎng)增強(qiáng)了我國(guó)司法透明度、提高民事執(zhí)行效率以及極大的節(jié)約我國(guó)司法成本。同時(shí),互聯(lián)網(wǎng)的發(fā)展對(duì)民事執(zhí)行啟動(dòng)程序、民事執(zhí)行標(biāo)的、民事執(zhí)行管轄、民事執(zhí)行措施帶來(lái)極大的沖擊影響。第三章主要研究在互聯(lián)網(wǎng)環(huán)境下,我國(guó)民事執(zhí)行立案、執(zhí)行標(biāo)的、執(zhí)行管轄和執(zhí)行強(qiáng)制措施在適用中所遇到的問(wèn)題。第四章針對(duì)問(wèn)題給出完善建議。在執(zhí)行立案方面,開(kāi)發(fā)使用統(tǒng)一的執(zhí)行立案系統(tǒng),確認(rèn)網(wǎng)上執(zhí)行立案的效力。在執(zhí)行標(biāo)的方面,擴(kuò)大執(zhí)行對(duì)象范圍,加強(qiáng)與其他部門(mén)的合作。在執(zhí)行管轄方面,建立在線監(jiān)督委托執(zhí)行,同時(shí),制定虛擬財(cái)產(chǎn)法律制度。在執(zhí)行措施中,完善我國(guó)執(zhí)行指揮系統(tǒng),實(shí)現(xiàn)通過(guò)互聯(lián)網(wǎng)對(duì)財(cái)產(chǎn)進(jìn)行凍結(jié)、扣劃。同時(shí)完善網(wǎng)上司法拍賣系統(tǒng),加強(qiáng)互聯(lián)網(wǎng)執(zhí)行威懾。第五章為本論文的結(jié)束語(yǔ),我國(guó)目前對(duì)于互聯(lián)網(wǎng)環(huán)境下民事執(zhí)行機(jī)制研究尚處于初級(jí)階段,還存在諸多問(wèn)題,比如法律制度的相對(duì)落后以及技術(shù)方面不夠成熟。故僅以此文,為完善我國(guó)互聯(lián)網(wǎng)環(huán)境下的民事執(zhí)行機(jī)制盡綿薄之力。
[Abstract]:The development of Internet technology has created a wide information communication platform for us to extend the space of human activity from the physical field to the invisible Internet space. In order to better solve the problems of civil execution and disorderly execution, Chinese courts have gradually tried to use Internet technology in the civil execution process. In the process of its exploration, civil enforcement in the Internet environment also faces many difficult problems. This paper will focus on the problems existing in China's civil execution under the Internet environment, and put forward suggestions for improving the application of China's civil execution mechanism under the Internet environment. This paper is divided into five chapters. The first chapter is the introduction. Our court's exploration of the civil execution mechanism under the Internet environment is still at its initial stage and faces many problems. This article will focus on the analysis of the problems faced by the civil enforcement mechanism under the Internet environment, and give some reasonable suggestions for these problems. The second chapter is mainly to explain that the Internet has brought positive impact and impact on the civil execution of our country. In the positive impact, the Internet has enhanced the transparency of our judicature, improved the efficiency of civil execution and greatly saved the cost of our country's judicature. At the same time, the development of the Internet has a great impact on civil execution, civil execution, civil enforcement and civil execution. The third chapter mainly studies the problems encountered in the application of civil execution, registration, enforcement, enforcement and enforcement measures under the Internet environment. The fourth chapter gives some suggestions on the problem. In the implementation of the case, the development and use of a unified implementation of the case system, to confirm the effectiveness of the implementation of the case on the Internet. Our current research on the civil execution mechanism under the Internet environment is still in its initial stage, and there are still many problems, such as the backward legal system and the immature technology. Therefore, only in this article, to improve the civil enforcement mechanism under the Internet environment in our country to do the best.
