【摘要】：公共產(chǎn)品經(jīng)濟(jì)是一個(gè)與私人產(chǎn)品經(jīng)濟(jì)不同的領(lǐng)域,有其獨(dú)特的性質(zhì)、供給機(jī)制與消費(fèi)特征,市場(chǎng)機(jī)制不能正常發(fā)揮作用,需要國(guó)家經(jīng)濟(jì)權(quán)力在此進(jìn)行強(qiáng)有力的干預(yù),由此產(chǎn)生的各類(lèi)經(jīng)濟(jì)關(guān)系需要法律的有效調(diào)整。公共產(chǎn)品法律調(diào)整在調(diào)整對(duì)象、價(jià)值取向、調(diào)整原則及調(diào)整方式上的特點(diǎn)使其在法律調(diào)整模式選擇上超越民商法、行政法等而與經(jīng)濟(jì)法形成價(jià)值基準(zhǔn)與方法論的對(duì)接,對(duì)公共產(chǎn)品進(jìn)行經(jīng)濟(jì)法審視對(duì)經(jīng)濟(jì)轉(zhuǎn)型時(shí)期的中國(guó)具有重要的理論與現(xiàn)實(shí)意義。
[Abstract]:The economy of public goods is a different field from the economy of private goods. It has its unique nature, the characteristics of supply mechanism and consumption, and the market mechanism can not function properly, so it needs the powerful intervention of the state economic power. All kinds of economic relations need to be adjusted effectively by law. The legal adjustment of public goods has the characteristics of adjusting object, value orientation, principle and mode of adjustment so that it surpasses the choice of civil and commercial law, administrative law and economic law to form the docking of value standard and methodology with economic law. It is of great theoretical and practical significance to examine the economic law of public goods in China during the period of economic transformation.
