我國沿海內(nèi)河船舶保險(xiǎn)法律問題研究

【摘要】:我國沿海內(nèi)河航運(yùn)業(yè)正處于發(fā)展時(shí)期,然而在沿海內(nèi)河船舶保險(xiǎn)實(shí)踐中存在很多法律爭(zhēng)議,在一定程度上影響了我國沿海內(nèi)河船舶保險(xiǎn)市場(chǎng)的有序健康發(fā)展,比如沿海內(nèi)河船舶中保險(xiǎn)價(jià)值問題;保險(xiǎn)人能否以船舶不適航為由拒賠問題;共同海損、救助及施救費(fèi)用應(yīng)不應(yīng)該一并算入保險(xiǎn)賠償限額中等等。然而目前國內(nèi)對(duì)上述問題的論述較少。本文結(jié)合我國《海商法》、《保險(xiǎn)法》等法律規(guī)定以及中國人民銀行制定的《沿海內(nèi)河船舶保險(xiǎn)條款》的相關(guān)規(guī)定,以上述三個(gè)方面的法律問題為主要研究對(duì)象,系統(tǒng)闡析我國沿海內(nèi)河船舶保險(xiǎn)中存在的法律問題,以期對(duì)我國的沿海內(nèi)河船舶保險(xiǎn)提供借鑒。 本文除去引言和結(jié)論,可分成四部分。 第一部分為我國沿海內(nèi)河船舶保險(xiǎn)概述。該部分主要介紹沿海內(nèi)河船舶保險(xiǎn)合同的概念、特點(diǎn)及它的法律適用,并介紹了《沿海內(nèi)河船舶保險(xiǎn)條款》的由來、法律效力和落后性,在此基礎(chǔ)上提出當(dāng)前存在的幾個(gè)比較大的法律爭(zhēng)議。 第二部分為沿海內(nèi)河船舶保險(xiǎn)中保險(xiǎn)價(jià)值問題。本部分以案例為切入點(diǎn)分析了沿海內(nèi)河船舶保險(xiǎn)中保險(xiǎn)標(biāo)的的保險(xiǎn)價(jià)值認(rèn)定以及保險(xiǎn)價(jià)值和實(shí)際價(jià)值的相互關(guān)系,以及在實(shí)踐中如何處理保險(xiǎn)價(jià)值超過實(shí)際價(jià)值的問題。 第三部分為沿海內(nèi)河船舶保險(xiǎn)中船舶不適航除外責(zé)任問題。本部分首先介紹了船舶適航的概念,并介紹了各國法律對(duì)船舶適航的法律規(guī)定;其次通過我國海商法和《沿海內(nèi)河船舶保險(xiǎn)條款》的比較,深入剖析了我國沿海內(nèi)河船舶保險(xiǎn)條款中船舶不適航除外責(zé)任的不合理問題;再次通過對(duì)《沿海內(nèi)河船舶保險(xiǎn)條款解釋》中船舶不適航除外責(zé)任規(guī)定的分析,明確了其中的不合理內(nèi)容,并在此基礎(chǔ)上提出完善建議。 第四部分為沿海內(nèi)河船舶保險(xiǎn)中不同性質(zhì)費(fèi)用的賠償問題,本部分針對(duì)我國《沿海內(nèi)河船舶保險(xiǎn)條款》中將三種費(fèi)用一并算入賠償限額的不合理規(guī)定,通過分析三種費(fèi)用的不同性質(zhì),并結(jié)合我國《海商法》的規(guī)定,認(rèn)為在《沿海內(nèi)河船舶保險(xiǎn)條款中》應(yīng)根據(jù)具體的賠付情形、賠付標(biāo)準(zhǔn)、賠付依據(jù)進(jìn)行區(qū)分賠付,建立有效的賠付機(jī)制。
[Abstract]:China's coastal inland shipping industry is in a period of development. However, there are many legal disputes in the practice of coastal inland shipping insurance, which to some extent affect the orderly and healthy development of the coastal inland shipping insurance market in China. For example, the problem of the insurance value in the coastal inland river ships; whether the insurer can refuse to compensate for the unseaworthiness of the ship; whether the general average, rescue and rescue expenses should be included in the limit of insurance compensation and so on. However, at present, the domestic discussion of the above issues is less. Combined with the relevant provisions of China's Maritime Law and Insurance Law, and the relevant provisions of the "Coastal River Shipping Insurance Clause" formulated by the people's Bank of China, the above three legal issues are taken as the main objects of study in this paper. This paper systematically analyzes the legal problems existing in the marine insurance of coastal inland rivers in China, in order to provide reference for the insurance of coastal inland waterways in China. Apart from the introduction and conclusion, this paper can be divided into four parts. The first part is an overview of China's coastal inland river ship insurance. This part mainly introduces the concept, characteristics and legal application of the coastal inland river ship insurance contract, and introduces the origin, legal effect and backwardness of "the coastal inland river ship insurance clause". On this basis, several existing legal disputes are put forward. The second part is about the value of insurance in the marine insurance of coastal inland rivers. This part takes the case as the breakthrough point to analyze the insurance value of the insured subject matter in the coastal inland river ship insurance, the relationship between the insurance value and the actual value, and how to deal with the problem that the insurance value exceeds the actual value in practice. The third part is the exception of ship unseaworthiness in coastal river vessel insurance. This part first introduces the concept of ship seaworthiness, and introduces the legal provisions of various countries on ship seaworthiness. Secondly, through the comparison between China's maritime law and the "Coastal Inland River Shipping Insurance Clause", This paper deeply analyzes the unreasonable problem of ship unseaworthiness exception liability in China's coastal inland waterway ship insurance clause, and then analyzes the ship unseaworthiness exception liability provision in "interpretation of coastal inland river ship insurance clause". The unreasonable content is clarified, and on this basis, some suggestions are put forward. The fourth part is the compensation problem of the different nature expense in the coastal inland river ship insurance. This part is aimed at the unreasonable stipulation that the three kinds of expenses are taken into account as the compensation limit in our country "the coastal inland river ship insurance clause". By analyzing the different properties of the three kinds of fees and combining the provisions of China's Maritime Law, it is considered that in the "Coastal River Shipping Insurance Clause", it should be based on the specific conditions of compensation, the standard of compensation, and the basis of compensation. Establish an effective compensation mechanism.
