【摘要】:港口對促進(jìn)國民經(jīng)濟(jì)的快速發(fā)展發(fā)揮著越來越重要的作用,然而,目前港口法律環(huán)境卻存著與港口發(fā)展形勢不相適應(yīng)的地方!陡劭诜ā冯m然出臺,遺憾的是該部法律僅僅調(diào)整了港口縱向的行政法律關(guān)系,對港口橫向的民事法律關(guān)系卻沒有規(guī)范,在港口經(jīng)營過程中產(chǎn)生的民事法律問題適用運(yùn)輸法律還是適用一般的民法和合同法,仍是需要迫切回答的問題。港口經(jīng)營人的法律地位是解決港口民事法律關(guān)系的基礎(chǔ),結(jié)合我國港口經(jīng)營人的實(shí)際,,深入研究港口經(jīng)營人的法律地位,具有重要的理論與實(shí)踐意義。本文試圖做這方面的探索。 本文第一章介紹了港口的定義、分類以及今后的發(fā)展前景,簡要分析了港口立法的演變過程,港口立法大致分三個階段,第一階段是95年以前,沒有單獨(dú)的港口立法,調(diào)整承運(yùn)人的法律法規(guī)同時也規(guī)范港口法律關(guān)系。第二階段是95年—2003年,這期間港口法律關(guān)系逐漸從運(yùn)輸法律關(guān)系中分離出來,2001年交通部頒布了專門調(diào)整港口民事法律關(guān)系的部門規(guī)章《港口作業(yè)規(guī)則》。第三階段是2003年以后,港口立法上升為法律,《港口法》頒布實(shí)施。 第二章著重分析了我國港口經(jīng)營人的定義和范圍。 第三章通過幾個案例說明了目前司法審判實(shí)際中對港口經(jīng)營人法律定位的三種觀點(diǎn),分析了三種觀點(diǎn)的利弊,并通過國際公約中港口經(jīng)營人法律定位的變化,得出港口經(jīng)營人應(yīng)確立為實(shí)際承運(yùn)人的結(jié)論。 第四章在港口經(jīng)營人確立為實(shí)際承運(yùn)人法律地位的前提下,分析了港口經(jīng)營人的法律責(zé)任,包括港口經(jīng)營人責(zé)任的性質(zhì)、責(zé)任期間,責(zé)任限制等。 第五章提出了修訂《海商法》中有關(guān)實(shí)際承運(yùn)人規(guī)定的立法建議,擴(kuò)大實(shí)際承運(yùn)人的范圍,把港口經(jīng)營人納入到實(shí)際承運(yùn)人的范圍內(nèi)進(jìn)行調(diào)整。
[Abstract]:Ports play an increasingly important role in promoting the rapid development of the national economy. However, at present, the port legal environment is not suitable for the port development situation. Unfortunately, the Ministry's law only adjusts the longitudinal administrative and legal relationship of the port, but it does not regulate the horizontal civil legal relationship of the port. It is still an urgent question whether to apply the transportation law or to apply the general civil law and contract law in the process of port operation. The legal status of the port operator is the basis of solving the legal relationship of port civil affairs. It is of great theoretical and practical significance to study the legal status of the port operator in depth in combination with the reality of the port operator in our country. This article attempts to do this aspect of exploration. The first chapter introduces the definition, classification and future development prospects of the port, and briefly analyzes the evolution process of the port legislation. The port legislation is roughly divided into three stages. The first stage is before 95 years, and there is no separate port legislation. Adjust the carrier's laws and regulations, but also regulate port legal relations. The second stage was from 1995 to 2003, during which the port legal relationship was gradually separated from the transport legal relationship. In 2001, the Ministry of Communications promulgated the regulations of the Department of Port Operations which specially regulated the port civil legal relations. The third stage is after 2003, the port legislation rises to the law, the Port Law is promulgated and implemented. The second chapter analyzes the definition and scope of port operator in China. The third chapter explains the three views on the legal positioning of port operators in the judicial practice through several cases, analyzes the advantages and disadvantages of the three views, and changes the legal positioning of port operators through the international conventions. Draw the conclusion that the port operator should be established as the actual carrier. The fourth chapter analyzes the legal liability of the port operator under the premise that the port operator is established as the actual carrier, including the nature of the liability of the port operator, the period of liability, the limitation of liability and so on. The fifth chapter puts forward the legislative proposals to amend the provisions of the actual carrier in the Maritime Law, to expand the scope of the actual carrier and to bring the port operator into the scope of the actual carrier for adjustment.
