【摘要】：在美國(guó),隨著專(zhuān)利糾紛逐漸增多,調(diào)解制度應(yīng)用中的低成本和快捷性的優(yōu)勢(shì)日益凸顯,并廣泛被采納。通過(guò)對(duì)美國(guó)專(zhuān)利糾紛調(diào)解制度及其實(shí)施情況的考察,可見(jiàn)其不僅制度健全,調(diào)解機(jī)構(gòu)設(shè)立和職能、調(diào)解原則、調(diào)解程序等規(guī)定比較科學(xué),而且充分顯示了民間調(diào)解機(jī)構(gòu)和方式在專(zhuān)利糾紛調(diào)解中的優(yōu)勢(shì)及存在價(jià)值。借鑒美國(guó)經(jīng)驗(yàn),我國(guó)需要確立民間調(diào)解為主的專(zhuān)利糾紛調(diào)解機(jī)制,逐步弱化司法調(diào)解,替代行政調(diào)解。
[Abstract]:In the United States, with the increasing number of patent disputes, the advantages of low cost and rapidity in the application of mediation system are becoming increasingly prominent and widely adopted. Through the investigation of the patent dispute mediation system and its implementation in the United States, we can see that it is not only a sound system, the establishment and functions of mediation institutions, mediation principles, mediation procedures and other provisions are relatively scientific. It also shows the advantage and value of folk mediation organization and method in patent dispute mediation. Drawing lessons from American experience, China needs to establish a patent dispute mediation mechanism based on folk mediation and gradually weaken judicial mediation to replace administrative mediation.
