【摘要】：目前關(guān)于土地問題的討論容易陷入土地公有還是私有這一對(duì)立框架的理論迷思當(dāng)中�；谝环N從現(xiàn)實(shí)出發(fā)的理論解釋路徑,土地公有制不是一個(gè)抽象的名詞和固定不變的理論預(yù)設(shè),而在中國土地實(shí)踐的歷史和現(xiàn)實(shí)語境當(dāng)中呈現(xiàn)出開放性的理論空間。從一種對(duì)土地公有制的積極理解出發(fā),可能會(huì)支持某種強(qiáng)意義上的個(gè)人土地財(cái)產(chǎn)權(quán)主張,從而使土地公有制和個(gè)人土地財(cái)產(chǎn)權(quán)并不對(duì)立�；谡材匪埂に岢龅年P(guān)于包容性權(quán)利和排他性權(quán)利這一對(duì)概念所構(gòu)造的分析框架,土地財(cái)產(chǎn)權(quán)不僅呈現(xiàn)出國家所有的"共有"維度,而且必須特定化為個(gè)人所有的"個(gè)體"維度。這一對(duì)土地財(cái)產(chǎn)權(quán)的二維解讀,不僅深度契合當(dāng)下中國現(xiàn)實(shí)的土地制度設(shè)置,也是對(duì)中國憲法動(dòng)態(tài)發(fā)展中所蘊(yùn)含的那種財(cái)產(chǎn)權(quán)觀念的一種理論闡釋。
[Abstract]:The current discussion on land issues is prone to fall into the theoretical myth of whether land is public or private. Based on a theoretical interpretation path based on reality, land public ownership is not an abstract term and fixed theoretical presupposition, but presents an open theoretical space in the historical and realistic context of land practice in China. Starting from a positive understanding of the public ownership of land, it may support the claim of individual land property right in a strong sense, so that the public ownership of land and the property right of individual land can not be opposed. Based on the analytical framework proposed by James Tarly on the concept of inclusive and exclusive rights, land property rights not only show the "common" dimension of state ownership. And it must be specific to the individual dimension. This two-dimensional interpretation of land property rights is not only a deep agreement with the present Chinese land system, but also a theoretical interpretation of the concept of property rights contained in the dynamic development of the Chinese Constitution.
