【摘要】:正車位抵押的法律風險,主要是因立法活動落后于現(xiàn)實實踐,導致在車位所有權(quán)歸屬及業(yè)主優(yōu)先權(quán)等方面易出現(xiàn)糾紛,以及車位可能存在權(quán)利負擔,從而影響車位抵押權(quán)的有效設立或最終實現(xiàn)。近些年來,隨著我國步入汽車社會,城市車位的價值開始凸顯。各地利用車位進行融資的現(xiàn)象逐漸增多,其中利用住宅小區(qū)與商業(yè)樓宇車位所有權(quán)進行抵押融資的較為普遍。然而,由于車位種類繁多、權(quán)屬復雜,加之"法律自制定頒布之日起,就注定落后
