【摘要】：2014年9月2日,國家版權局公布了《民間文學藝術作品著作權保護條例(征求意見稿)》,向公眾公開征求意見。民間文學藝術屬于非物質文化遺產的一部分。在司法審判實踐中,已有法院對包括民間文學藝術在內的非物質文化遺產私權保護作出判例,但是我國相關立法還不夠完善,造成司法實踐中的審判難題。故應通過司法實踐經驗,結合相關立法精神、法理、法律原則,從非物質文化遺產私權保護之法理基礎、權利主體、權利客體、權利類型與范圍、權利限制、民事責任等方面進行分析,并區(qū)別其與知識產權保護的不同,從而構建一套完整的包括民間文學藝術作品在內的非物質文化遺產私權保護之體系,以促進社會主義文化大發(fā)展、大繁榮,促進經濟自主協(xié)調發(fā)展。
[Abstract]:On September 2, 2014, the State copyright Administration published the regulations on the Protection of copyright in folklore and Art works (draft for comments), which are open to the public for comment. Folklore is a part of the intangible cultural heritage. In judicial practice, courts have made precedents on the protection of private rights of intangible cultural heritage, including folklore and art, but the relevant legislation in our country is not perfect enough, resulting in judicial problems in judicial practice. Therefore, through the experience of judicial practice, combining the relevant legislative spirit, legal theory, legal principle, from the legal basis of the protection of private rights of intangible cultural heritage, the subject of right, object of right, type and scope of right, restriction of right, etc. In order to promote the great development of socialist culture, civil liability and other aspects are analyzed, and the differences between civil liability and intellectual property protection are distinguished, so as to construct a complete system of protection of intangible cultural heritage, including folklore and art works, so as to promote the great development of socialist culture. Great prosperity, promote independent and coordinated development of the economy.
