【摘要】：近幾年來,隨著計(jì)算機(jī)技術(shù)和電子商務(wù)在世界范圍內(nèi)的迅速的發(fā)展,作為互聯(lián)網(wǎng)上的計(jì)算機(jī)的識(shí)別標(biāo)志,網(wǎng)絡(luò)域名便有了巨大的商業(yè)價(jià)值。隨之而來的是越來越多的的網(wǎng)絡(luò)域名搶注活動(dòng),使得這類問題顯得非常突出,由此一來非常有必要對(duì)這種行為進(jìn)行法律規(guī)制。雖然國(guó)家頒布相關(guān)的法律文件,但是由于網(wǎng)絡(luò)域名本身的特殊性,在某些方面,比如立法層面,司法管轄,許可注冊(cè)等方面還是很難充分地保護(hù)當(dāng)事人的合法權(quán)益。本文重點(diǎn)研究網(wǎng)絡(luò)域名搶注的法律規(guī)制。通過對(duì)網(wǎng)絡(luò)域名搶注的法律認(rèn)定的分析,著重研究關(guān)于如何有效的規(guī)制網(wǎng)絡(luò)域名搶注以及提出法律設(shè)想和建議。論文共分三部分:第一部分,對(duì)網(wǎng)絡(luò)域名搶注的基礎(chǔ)技術(shù)知識(shí)以及網(wǎng)絡(luò)域名搶注的動(dòng)因及分類進(jìn)行了闡述。第二部分,分析了我國(guó)網(wǎng)絡(luò)域名搶注的法律規(guī)制現(xiàn)狀以及存在的問題。第三部分,針對(duì)上述的存在問題提出了相應(yīng)的解決對(duì)策。
[Abstract]:In recent years, with the rapid development of computer technology and electronic commerce in the world, as the identification mark of the computer on the Internet, the domain name of the network has great commercial value. Following this, more and more online domain name grabbing activities make this kind of problem appear very prominent, so it is very necessary to regulate this kind of behavior. Although the country promulgates the related legal documents, due to the particularity of the network domain name itself, it is difficult to fully protect the legitimate rights and interests of the parties in some aspects, such as legislative level, jurisdiction, license registration and so on. This paper focuses on the legal regulation of domain name grabbing. Through the analysis of the legal cognizance of the online domain name preemption, this paper focuses on how to regulate the online domain name preemption effectively, and puts forward some legal ideas and suggestions. The paper is divided into three parts: the first part, the basic technical knowledge of domain name grabbing, the motivation and classification of domain name grabbing. The second part analyzes the current situation and existing problems of the legal regulation of domain name grabbing in China. In the third part, the author puts forward the corresponding solutions to the above problems.
