【摘要】：反向支付問題是創(chuàng)新藥和仿制藥競爭與博弈機(jī)制下難以回避的情形。隨著國內(nèi)仿制藥產(chǎn)業(yè)的發(fā)展和藥品專利制度的改革,以及創(chuàng)新藥專利懸崖期的到來,反向支付問題將可能大量涌現(xiàn)。本文通過梳理與反向支付問題有關(guān)的典型案例及審查適用原則,希望對我國完善藥品專利制度和反壟斷執(zhí)法工作有所幫助。
[Abstract]:The reverse payment problem is unavoidable under the competition and game mechanism of innovative drugs and generic drugs.With the development of domestic generic drug industry, the reform of drug patent system, and the arrival of patent cliff period, reverse payment problems may emerge in large numbers.By combing the typical cases related to reverse payment and examining the applicable principles, this paper hopes to be helpful to improve the drug patent system and anti-monopoly law enforcement in China.
