【摘要】：《民法總則》第111條對個(gè)人信息保護(hù)規(guī)則作出了規(guī)定,肯定了個(gè)人信息的人格利益屬性,為個(gè)人信息權(quán)利保護(hù)提供了民事基本法依據(jù)�！睹穹ǹ倓t》僅使用個(gè)別條文對各項(xiàng)具體人格權(quán)以及個(gè)人信息保護(hù)作出規(guī)定,并沒有真正完成對各項(xiàng)具體人格權(quán)的確權(quán)。民法典應(yīng)通過獨(dú)立成編的人格權(quán)法,對各項(xiàng)具體人格權(quán)進(jìn)行進(jìn)一步確權(quán);就個(gè)人信息權(quán)而言,人格權(quán)編應(yīng)當(dāng)在肯定其具體人格權(quán)地位的基礎(chǔ)上,準(zhǔn)確界定個(gè)人信息的內(nèi)涵,明確合法收集、利用個(gè)人信息的標(biāo)準(zhǔn),并對信用信息保護(hù)規(guī)則以及個(gè)人信息權(quán)的限制規(guī)則等作出規(guī)定。
[Abstract]:Article 111 of the General principles of Civil Law stipulates the rules for the protection of personal information and affirms the personal interest attribute of personal information.It provides the basis of the civil basic law for the protection of the personal information right. The General provisions of the Civil Law only use individual articles to stipulate the specific personality right and the personal information protection, and do not really complete the right to confirm the individual personality right.The civil code should adopt the law of personality right which is made up independently to confirm the right of individual personality, and on the basis of affirming the status of personal right of personality, it should define the connotation of personal information accurately, as far as the right of personal information is concerned, the right of personality right should be defined on the basis of affirming the status of personal right of personality.It is clear that the standard of collecting and utilizing personal information is clear, and the rules of credit information protection and the restriction of personal information right are stipulated.
