【摘要】：當(dāng)遺忘成為常態(tài),公民的精神利益就存在著受損的可能性,而如何保護公民的這項權(quán)益也就成了需要解決的問題。被遺忘權(quán)的提出就是基于此。因此,被遺忘權(quán)在當(dāng)今互聯(lián)網(wǎng)時代有著很強的現(xiàn)實意義。在大數(shù)據(jù)時代,數(shù)據(jù)的價值愈發(fā)突出,對數(shù)據(jù)的處理也越來越精細化,世界各國對于個人數(shù)據(jù)立法越來越重視,而這也帶來了數(shù)據(jù)主體對于自身數(shù)據(jù)的擔(dān)憂。在這樣的背景下,本文擬通過介紹被遺忘權(quán)的淵源,分析其在域外的立法與實踐以及通過對我國的立法建議,以期對我國將來的立法有所助益。本文共分為三章:第一章是網(wǎng)絡(luò)環(huán)境下被遺忘權(quán)以及我國立法構(gòu)建的法律障礙。介紹了一下被遺忘權(quán)的歷史淵源。其中包括從遺忘權(quán)到被遺忘權(quán)的變遷,被遺忘權(quán)構(gòu)建的合理性以及我們目前立法構(gòu)建的困境。第二章是域外網(wǎng)絡(luò)環(huán)境下被遺忘權(quán)的立法、實踐以及借鑒。首先,介紹了歐盟的立法及實踐情況。詳細解釋了歐盟GDPR里的被遺忘權(quán)的概念、內(nèi)容以及救濟。其次,介紹了美國的實踐情況。由于言論自由在美國地位無可撼動,所以美國沒有GDPR意義上的被遺忘權(quán),但是關(guān)于言論自由與個人信息保護的平衡也是被努力尋找的對象。再次,介紹了日本、臺灣以及OECD的與個人數(shù)據(jù)以及隱私保護相關(guān)立法與文件。最后,通過上述介紹的比較,總結(jié)出了實踐與立法的幾點不同,這對我國的選擇具有一定的啟發(fā)意義。第三章是我國網(wǎng)絡(luò)環(huán)境下被遺忘權(quán)的立法構(gòu)建。通過第一章的初步引入,到第二章的域外深入介紹,最終還是要落腳到我們大陸的立法構(gòu)建上來。本章首先對被遺忘權(quán)的概念做出了界定,其次分析了它的性質(zhì)與地位,最后詳細給出了被遺忘權(quán)內(nèi)容與救濟。
[Abstract]:When forgetting becomes the norm, the moral interests of citizens are likely to be damaged, and how to protect the rights and interests of citizens becomes a problem that needs to be solved. The right to be forgotten is of great practical significance in today's Internet age. In big data's time, the value of data has become more and more prominent, the processing of data has become more and more refined, and countries in the world have paid more and more attention to personal data legislation. Under this background, this paper intends to introduce the origin of the right to be forgotten, analyze its legislation and practice abroad, and adopt legislative suggestions to our country. This paper is divided into three chapters: the first chapter is the right to be forgotten under the network environment and the legal obstacles to the legislative construction of our country. This paper introduces the historical origin of the right to be forgotten. The change from the right of forgetting to the right to be forgotten, The second chapter is the legislation, practice and reference of the right to be forgotten under the extraterritorial network environment. This paper introduces the legislation and practice of the European Union. It explains in detail the concept, content and relief of the right to be forgotten in the GDPR of the EU. Secondly, it introduces the practice of the United States. Since the status of freedom of speech in the United States is unassailable, So the United States does not have the right to be forgotten in the sense of GDPR, but the balance between freedom of speech and the protection of personal information is also the object of hard work. Taiwan and OECD's legislation and documents related to personal data and privacy protection. Finally, through the comparison of the above introductions, we conclude that there are several differences between practice and legislation. The third chapter is the legislative construction of the right to be forgotten in the network environment of our country. This chapter firstly defines the concept of the right to be forgotten, then analyzes its nature and status, and finally gives the content and relief of the right to be forgotten in detail.
