【摘要】：商標延伸問題是近年來我國司法實踐中出現(xiàn)的新型問題,理論界對此關注較少。商標延伸問題源起于經(jīng)營者在激烈市場競爭條件下延續(xù)現(xiàn)有品牌優(yōu)勢的現(xiàn)實考量。從本質(zhì)上分析,商標延伸的初級本質(zhì)是商譽的延伸、二級本質(zhì)是價值的延伸、三級本質(zhì)是勞動的延伸、終級本質(zhì)是能量的延伸。商標延伸的類型主要可劃分商標縱向延伸、商標橫向延伸、商標斷續(xù)延伸三類。商標延伸的誤區(qū)在于不承認商標權利可以延伸、任何注冊商標權利均可延伸兩個方面。規(guī)范商標延伸問題既是物質(zhì)生產(chǎn)方式的要求,也具有比較法上的基礎。當前,我國處理商標延伸問題應當從商標法層面、行政法規(guī)層面、司法解釋層面予以分別規(guī)范和完善。
[Abstract]:Trademark extension is a new problem in the judicial practice of our country in recent years. The problem of trademark extension originates from the realistic consideration of the operator to extend the existing brand advantage under the condition of fierce market competition. In essence, the primary essence of trademark extension is the extension of goodwill. The second essence is the extension of value, the third essence is the extension of labor, and the final essence is the extension of energy. The types of trademark extension can be divided into vertical extension and horizontal extension. The misconception of trademark extension lies in not recognizing that trademark rights can be extended, and any registered trademark rights can be extended in two aspects. Standardizing trademark extension is the requirement of material production mode. At present, China's handling of trademark extension should be regulated and perfected from the aspects of trademark law, administrative regulations and judicial interpretation.
