勞動(dòng)者忠實(shí)義務(wù)研究

【摘要】:勞動(dòng)者與用人單位之間的相互信賴是維系和諧勞動(dòng)關(guān)系的基礎(chǔ)。就勞動(dòng)者而言,善盡忠實(shí)義務(wù)是其獲得用人單位信任的關(guān)鍵。勞動(dòng)者忠實(shí)義務(wù)是以維護(hù)用人單位合法利益為目標(biāo),基于誠(chéng)實(shí)信用原則以及勞動(dòng)關(guān)系的繼續(xù)性、從屬性特征而對(duì)用人單位履行的以服從、告知、保密、競(jìng)業(yè)限制等為基本內(nèi)容的各項(xiàng)作為義務(wù)與不作為義務(wù)的總稱。忠實(shí)義務(wù)兼具倫理性特質(zhì)與社會(huì)法屬性。在現(xiàn)代勞動(dòng)關(guān)系背景下,忠實(shí)義務(wù)建立在勞動(dòng)者的獨(dú)立人格之上,勞資雙方不再是主仆身份關(guān)系,因此忠實(shí)義務(wù)不能無(wú)限擴(kuò)大而成為用人單位限制勞動(dòng)者追求個(gè)人合法權(quán)益的枷鎖。為發(fā)揮勞動(dòng)者忠實(shí)義務(wù)的積極作用,在維護(hù)用人單位合法利益的同時(shí)兼顧勞動(dòng)者以及其他主體的利益,對(duì)勞動(dòng)者忠實(shí)義務(wù)的程度及行為標(biāo)準(zhǔn)進(jìn)行合理的考量便顯得尤為重要,考量的因素應(yīng)包括不同層次勞動(dòng)者的差異性、忠實(shí)義務(wù)是否及于勞動(dòng)者的職務(wù)外行為、勞動(dòng)者的重大法益以及社會(huì)公共利益等內(nèi)容。追究勞動(dòng)者違反忠實(shí)義務(wù)的法律責(zé)任時(shí)應(yīng)考慮勞資雙方強(qiáng)弱勢(shì)力量的對(duì)比而限制當(dāng)事人之間的契約自由并采取過(guò)錯(cuò)責(zé)任原則。勞動(dòng)者違反忠實(shí)義務(wù)主要承擔(dān)用人單位懲戒與損害賠償責(zé)任;趧趧(dòng)者的弱勢(shì)地位與傾斜保護(hù)勞動(dòng)者的價(jià)值取向,當(dāng)前立法的關(guān)注點(diǎn)主要集中于勞動(dòng)者的權(quán)利方面,對(duì)勞動(dòng)者義務(wù)的規(guī)定存在不足之處,有必要對(duì)勞動(dòng)者忠實(shí)義務(wù)的基本內(nèi)容、考量因素、違反該義務(wù)所承擔(dān)的法律后果等方面予以完善。
[Abstract]:The mutual trust between laborer and employer is the basis of maintaining harmonious labor relationship. As far as the laborer is concerned, it is the key to obtain the trust of the employer to fulfill the duty of loyalty. The duty of loyalty of the laborer is to safeguard the legitimate interests of the employing unit, based on the principle of good faith and the continuation of the labor relations, according to the characteristics of the attributes of the unit of choose and employ persons to comply with, inform, keep secret, The general term of obligation of action and obligation of omission, which is the basic content of the restriction of competition. The duty of loyalty has both ethical characteristics and social law attributes. Under the background of modern labor relations, the duty of loyalty is based on the independent personality of the laborer. Therefore, the duty of loyalty can not be expanded infinitely and become the shackles of employers to restrict workers from pursuing their legitimate rights and interests. In order to give full play to the positive role of laborer's duty of loyalty, it is particularly important to take into account the interests of workers and other subjects while safeguarding the legitimate interests of the employer, so it is particularly important to take reasonable account of the degree of the duty of loyalty and the standard of conduct of the laborer. The factors to be considered should include the differences of workers at different levels, whether the duty of loyalty is due to the outside behavior of workers, the major legal interests of workers and the public interests of society and so on. When investigating the legal liability of workers for violating the duty of loyalty, we should consider the contrast between the strong and weak forces of labor and management, and restrict the freedom of contract between the parties and adopt the principle of fault liability. The laborer violates the faithful duty mainly to undertake the unit of choose and employ persons discipline and the damage compensation responsibility. Based on the weak position of the laborer and the value orientation of protecting the laborer, the focus of the current legislation is mainly on the rights of the laborer, and the stipulation of the laborer's obligation has some shortcomings. It is necessary to perfect the basic contents, factors and the legal consequences of violation of the duty of loyalty.
