【摘要】：作為金融業(yè)的基礎,銀行對國民經濟的發(fā)展起著至關重要的作用。近年來我國審慎推動銀行業(yè)改革創(chuàng)新,鼓勵發(fā)展民營銀行。然而民營銀行自擔風險、股東資質、市場定位、股東接受監(jiān)管、風險處置和恢復計劃等法律問題亟需解決。民營銀行作為經濟領域新型、特殊的發(fā)展主體,應當具有相應的發(fā)展權,要明晰發(fā)展權的主體、內容、客體,并與安全權有機統(tǒng)一,促進相應的法律機制創(chuàng)新,在保障金融安全的基礎上實現健康發(fā)展。具體而言,保障民營銀行發(fā)展的內部法律機制包括主體確立、市場定位、自擔風險、危機應對等;外部法律機制則包括政府促進與監(jiān)管、市場約束機制、法律責任追究等。
[Abstract]:As the foundation of financial industry, banks play a vital role in the development of national economy. In recent years, China has prudently promoted banking reform and innovation, encouraging the development of private banks. However, the legal problems of private banks such as risk, stockholder qualification, market orientation, shareholder acceptance of supervision, risk disposal and recovery plan need to be solved. As a new and special development subject in the economic field, the private banks should have the corresponding right to development. They should make clear the subject, content and object of the right to development, and organically unify with the right of security to promote the innovation of the corresponding legal mechanism. We will achieve sound development on the basis of ensuring financial security. In particular, the internal legal mechanisms to ensure the development of private banks include the establishment of the main body, market positioning, self-risk, crisis response, and so on; the external legal mechanisms include government promotion and supervision, market restraint mechanism, legal liability investigation and so on.
