我國(guó)“三網(wǎng)融合”中壟斷行為的法律規(guī)制

【摘要】:二十一世紀(jì)是科學(xué)技術(shù)不斷更新,經(jīng)濟(jì)發(fā)展蒸蒸日上的時(shí)代!叭W(wǎng)融合”問(wèn)題多年來(lái)一直是產(chǎn)業(yè)管理學(xué)、法學(xué)及政治經(jīng)濟(jì)學(xué)等多門(mén)學(xué)科研究的熱點(diǎn)。2010年國(guó)務(wù)院常務(wù)會(huì)議的召開(kāi),是我國(guó)“三網(wǎng)融合”發(fā)展的里程碑,因?yàn)榇舜螘?huì)議決定加快推進(jìn)電信網(wǎng)、廣播電視網(wǎng)和互聯(lián)網(wǎng)在我國(guó)的融合。至此,廣播電視產(chǎn)業(yè)和電信產(chǎn)業(yè)互不往來(lái)的時(shí)代終于結(jié)束,雙方會(huì)在各個(gè)業(yè)務(wù)領(lǐng)域不斷深入合作發(fā)展,競(jìng)爭(zhēng)與合作將成為“三網(wǎng)融合”中相關(guān)產(chǎn)業(yè)的發(fā)展常態(tài)。2015年3月,國(guó)務(wù)院總理李克強(qiáng)在政府工作報(bào)告中提到,全面推進(jìn)“三網(wǎng)融合”加快建設(shè)光纖網(wǎng)絡(luò),大幅提升寬帶網(wǎng)絡(luò)速率,把新興消費(fèi)搞得紅紅火火。這說(shuō)明“三網(wǎng)融合”的發(fā)展受到政府的高度重視和支持,將會(huì)在我國(guó)廣泛開(kāi)展!叭W(wǎng)融合”意味著市場(chǎng)中的通信業(yè)務(wù)都將變?yōu)閿?shù)字信號(hào)在統(tǒng)一的網(wǎng)絡(luò)中進(jìn)行交換和傳播,融合之后的市場(chǎng)所有運(yùn)營(yíng)商都可以開(kāi)展全業(yè)務(wù)經(jīng)營(yíng),包括固定電話、移動(dòng)電話、寬帶數(shù)據(jù)和網(wǎng)絡(luò)視頻等,這種數(shù)字產(chǎn)品是生產(chǎn)者和經(jīng)營(yíng)者提供的主要產(chǎn)品類(lèi)型。數(shù)字產(chǎn)品作為新經(jīng)濟(jì)時(shí)代的產(chǎn)物,雖然帶來(lái)相關(guān)產(chǎn)業(yè)的競(jìng)爭(zhēng)和發(fā)展的前景是不可估量的,但其也會(huì)對(duì)現(xiàn)有法律秩序造成巨大的沖擊。從我國(guó)現(xiàn)階段“三網(wǎng)融合”的發(fā)展來(lái)看,通信領(lǐng)域的快速發(fā)展不但有利于提高人民整體生活水平,而且有利于推動(dòng)我國(guó)整體技術(shù)領(lǐng)域的革新和經(jīng)濟(jì)上的發(fā)展,更好促進(jìn)社會(huì)整體進(jìn)步。然而,壟斷行為阻礙了這一進(jìn)程的發(fā)展!叭W(wǎng)融合”中的壟斷行為,極其隱蔽,嚴(yán)重危害競(jìng)爭(zhēng)市場(chǎng),不利于社會(huì)主義市場(chǎng)經(jīng)濟(jì)秩序的良性發(fā)展。電信、廣電等運(yùn)營(yíng)商為了謀得各自利益最大化,相互設(shè)置進(jìn)入壁壘,破壞競(jìng)爭(zhēng),損害消費(fèi)者利益。因此需要《反壟斷法》等相關(guān)競(jìng)爭(zhēng)性法律法規(guī)的介入以求規(guī)范引導(dǎo)市場(chǎng)正;l(fā)展。比如2011年11月9日,國(guó)家發(fā)改委通過(guò)央視獨(dú)家披露了對(duì)中國(guó)電信、中國(guó)聯(lián)通因涉嫌互聯(lián)網(wǎng)市場(chǎng)接入價(jià)格壟斷的反壟斷調(diào)查。如果調(diào)查屬實(shí),兩大運(yùn)營(yíng)商在市場(chǎng)接入中對(duì)寬帶接入采取價(jià)格歧視行為,違反《反壟斷法》可能會(huì)遭數(shù)億至數(shù)十億的罰款。這一事件被稱(chēng)為我國(guó)央企反壟斷第一案,也說(shuō)明了我國(guó)在逐步重視“三網(wǎng)融合”領(lǐng)域的壟斷問(wèn)題。面對(duì)“三網(wǎng)融合”中相關(guān)產(chǎn)業(yè)壟斷行為的新變化,即某些壟斷協(xié)議的減少、濫用市場(chǎng)支配地位的方法有變、縱向集中的加強(qiáng),我們需要找出在“三網(wǎng)融合”中壟斷行為的表現(xiàn)形式與認(rèn)定方法及其規(guī)制難點(diǎn),從而提出相應(yīng)的法律對(duì)策,即要借鑒國(guó)外的立法經(jīng)驗(yàn)、完善我國(guó)適用“三網(wǎng)融合”的法律制度,改善政府的管理和監(jiān)督,保障穩(wěn)定的市場(chǎng)競(jìng)爭(zhēng)秩序,以確保我國(guó)“三網(wǎng)融合”的順利進(jìn)行。
[Abstract]:The 21 century is a time when science and technology are constantly updated and economic development is flourishing. The issue of "triple network convergence" has been a hot topic in the field of industrial management, law and political economics for many years. The opening of the State Council executive meeting in 2010 is a milestone in the development of "three networks" in China. Because this meeting decided to accelerate the telecommunication network, the broadcast television network and the Internet fusion in our country. At this point, the era of non-contact between the radio and television industry and the telecommunications industry is finally over. The two sides will continue to deepen cooperation and development in various fields of business. Competition and cooperation will become the norm in the development of the related industries in the "three networks convergence." in March 2015, State Council Prime Minister Li Keqiang said in a government work report that comprehensive efforts to "triple play" speed up the construction of fiber optic networks, significantly increase the speed of broadband networks, and fuel new consumption. This shows that the development of "three-net convergence" is highly valued and supported by the government, and will be widely carried out in our country. "three networks convergence" means that the communication services in the market will become digital signal exchange and transmission in a unified network. All operators in the integrated market can conduct full-service operations, including fixed phones and mobile phones. Broadband data and network video, this digital product is the main type of product provided by producers and operators. Digital products as a product of the new economic era, although the prospect of competition and development of related industries is inestimable, it will also have a huge impact on the existing legal order. Judging from the development of the "three networks integration" in our country at the present stage, the rapid development of the communications field is not only conducive to improving the overall living standards of the people, but also conducive to promoting innovation and economic development in the overall technical field of our country. Better promote the overall progress of society. However, monopoly behavior hinders the development of this process. The monopoly behavior in "three networks fusion" is extremely hidden, seriously endangers the competitive market, and is not conducive to the benign development of the socialist market economic order. In order to maximize their respective benefits, telecom, radio and television operators set up barriers to entry, destroy competition and harm consumers' interests. Therefore, the intervention of relevant competitive laws and regulations, such as Antimonopoly Law, is needed in order to normalize the development of the market. For example, on November 9, 2011, the National Development and Reform Commission, through CCTV, disclosed an exclusive antitrust investigation into China Telecom, China Unicom, on suspicion of a price monopoly in the Internet market. If the investigation proves, the two operators in the market access to broadband access against price discrimination, the violation of the Anti-Monopoly Law could face hundreds of millions to billions of fines. This event is called the first case of anti-monopoly of central enterprises in our country, which also shows that our country is gradually paying attention to the monopoly problem in the field of "three nets convergence". In the face of the new changes in the monopoly behavior of the related industries in the "three networks convergence", that is, the decrease of some monopoly agreements, the change of the methods of abusing the dominant position of the market, and the strengthening of the vertical concentration, We need to find out the form of the monopoly behavior in the "three networks fusion", the identification method and the difficulty of its regulation, so as to put forward the corresponding legal countermeasures, that is, to use the foreign legislative experience for reference, and to perfect the legal system of "three nets fusion" in our country. Improve the management and supervision of the government, guarantee the stable market competition order, and ensure the smooth progress of the "three networks" in our country.
