【摘要】：近幾年來,我國農(nóng)村政策性金融的發(fā)展為農(nóng)村經(jīng)濟(jì)的發(fā)展提供了所需的部分資金和支持,但是在發(fā)展的過程中,我國農(nóng)村政策性金融制度的一系列問題也暴露了出來。我國農(nóng)村政策性金融的立法不健全,在運(yùn)行中存在許多的問題,而國外農(nóng)村政策性金融制度起步時(shí)間比較早,在農(nóng)村政策性金融的立法建設(shè)和完善方面積累了很多的經(jīng)驗(yàn)和教訓(xùn),對我國農(nóng)村政策性金融的立法完善有很多有益啟示。通過分析美國、日本等發(fā)達(dá)國家和印度等發(fā)展中國家的農(nóng)村政策性金融的法律制度,對國外的農(nóng)村政策性金融制度的經(jīng)驗(yàn)進(jìn)行總結(jié)可知,凡是農(nóng)村政策性金融制度健全的國家普遍重視法律的規(guī)范和保障作用,采用了立法先行的方法,并且在發(fā)展的過程中不斷的完善。文章首先綜合性的闡述了農(nóng)村政策性金融的基本理念,具體介紹了農(nóng)村政策性金融的概念、特征和功能,對何為農(nóng)村政策性金融有一個(gè)清晰的認(rèn)識；然后分析了我國農(nóng)村政策性金融在運(yùn)行中出現(xiàn)的問題和現(xiàn)行的法律法規(guī),包括機(jī)構(gòu)立法層次和監(jiān)管層次的法律文件；最后根據(jù)我國農(nóng)村政策性金融立法建設(shè)中存在的問題和需要,如立法缺失、定位不明確、監(jiān)管不力、業(yè)務(wù)范圍狹窄、組織制度不完備等提出完善我國農(nóng)村政策性金融制度的立法對策,主要包括農(nóng)村政策性銀行、農(nóng)村政策性保險(xiǎn)和農(nóng)村政策性金融監(jiān)管。
[Abstract]:In recent years, the development of rural policy-oriented finance in China has provided some necessary funds and support for the development of rural economy, but in the process of development, a series of problems in the rural policy-oriented finance system of our country have also been exposed. The legislation of rural policy-oriented finance in our country is not perfect, and there are many problems in its operation. It has accumulated a lot of experience and lessons in the legislative construction and perfection of rural policy-oriented finance, which has a lot of beneficial enlightenment to the legislative perfection of rural policy-oriented finance in our country. By analyzing the legal system of rural policy-oriented finance in the developed countries such as the United States, Japan and other developing countries such as India, and summing up the experience of the rural policy-oriented finance system in foreign countries, Countries with sound rural policy-oriented financial system generally attach importance to the normative and protective role of law, adopt the method of legislation first, and continue to improve in the process of development. At first, the paper expounds the basic concept of rural policy finance, introduces the concept, characteristics and functions of rural policy finance, and has a clear understanding of what is rural policy finance; Then it analyzes the problems in the operation of rural policy-oriented finance in China and the current laws and regulations, including the legal documents at the level of institutional legislation and supervision. Finally, according to the existing problems and needs in the construction of rural policy-oriented finance legislation in China, such as the lack of legislation, unclear positioning, weak supervision and narrow scope of business, The organization system is not perfect, and so on, and puts forward the legislative countermeasures to perfect the rural policy finance system of our country, mainly includes the rural policy bank, the rural policy insurance and the rural policy finance supervision.
