【摘要】：國家出資人代表與國資委的法律關(guān)系,目前有代理人說、代管人說、受托人說等理論,但均存在難以自圓其說的缺憾。國家出資人代表負(fù)有公法上的國資經(jīng)營與監(jiān)督職責(zé),實(shí)質(zhì)為國資委代表國家委派的公務(wù)代表,其與國資委當(dāng)為公法上的委任與代表關(guān)系。
[Abstract]:The legal relationship between the representatives of the state investors and the SASAC has been said by some agents, said by the agent, said by the trustee and so on, but there is a regret that it is difficult to justify itself. The representatives of state investors are responsible for the management and supervision of state capital in public law. In essence, they are the official representatives appointed by SASAC on behalf of the state, and the representatives and representatives of SASAC should be appointed and represented in public law.
