【摘要】：本文著眼于構(gòu)建光船租賃對(duì)抗力理論。光船租賃權(quán)對(duì)抗力理論源于一般租賃權(quán)的對(duì)抗力理論。在理論構(gòu)建的過程中,一般租賃權(quán)對(duì)抗力理論所存在的問題包括：具有對(duì)抗力的正當(dāng)性理由、租賃權(quán)的性質(zhì)、產(chǎn)生對(duì)抗力后的法律效果以及租賃權(quán)的對(duì)抗范圍等,在光船租賃對(duì)抗力理論中亦存在。同時(shí),光船租賃權(quán)對(duì)抗力理論構(gòu)建亦存在其特有問題,即光船租賃期間侵權(quán)以及違約責(zé)任主體認(rèn)定是否屬于光船租賃權(quán)對(duì)抗力理論涵攝范圍。本文將從上述理論問題出發(fā),通過對(duì)上述問題的厘清,構(gòu)建光船租賃對(duì)抗力理論的形式理性模型,并在此基礎(chǔ)上,從立法論和解釋論兩個(gè)角度,為我國(guó)今后立法方案以及司法解釋方案提出建議。本文的第一部分闡明了光船租賃對(duì)抗力的含義、特征及其構(gòu)成要件,為后文的論述奠定基礎(chǔ)。本文的第二部分論證了光船租賃對(duì)抗力的理論基礎(chǔ),包括光船租賃權(quán)的正當(dāng)性理由、光船租賃權(quán)的性質(zhì)以及光船租賃權(quán)的公示。本文的第三部分結(jié)合光船租賃對(duì)抗力的理論基礎(chǔ),對(duì)光船租賃權(quán)對(duì)抗力的對(duì)抗范圍以及產(chǎn)生對(duì)抗力后的法律效果進(jìn)行了厘清。本文第四部分是建立在上述論證的基礎(chǔ)上,完成了光船租賃對(duì)抗力理論的形式理性模型構(gòu)建；從立法論的角度,提供了完善我國(guó)光船租賃對(duì)抗力理論的立法方案；從解釋論的角度,為與光船租賃對(duì)抗力理論相關(guān)的法條提供了司法層面解釋法條的方案。
[Abstract]:This paper focuses on the construction of the bareboat charter adversarial force theory, which originates from the general leasehold adversarial force theory. The problems existing in the general theory of the adversarial force of the leasehold include the legitimate reason of the adversarial force, the nature of the leasehold, the legal effect after the antagonism and the scope of the antagonism of the leasehold, etc. At the same time, there are some special problems in the construction of the counteraction theory of bareboat charter right. That is, whether the tort during bareboat charter period and whether the subject of breach of contract is covered by the counterproductive force theory of bareboat charter right. The formal rational model of the theory of confrontation force of bareboat charter is constructed, and on this basis, from the angle of legislation theory and explanation theory, The first part of this paper clarifies the meaning, characteristics and components of the confrontation force of bareboat charter. The second part of this paper demonstrates the theoretical basis of the confrontation force of bareboat charter, including the justification of bareboat charter right. The nature of bareboat charter right and the publicity of bareboat charter right. This paper clarifies the range of confrontation force of bareboat charter right and the legal effect after producing confrontation force. Part 4th of this paper is based on the above argument and completes the formal rational model construction of the theory of confrontation force of bareboat charter. From the point of view of legislation, this paper provides a legislative scheme to perfect the theory of confrontation force of bareboat charters in China, and from the angle of explanation theory, provides a judicial interpretation scheme for the articles related to the theory of confrontation force of bareboat charters.
