【摘要】： 贍養(yǎng)協(xié)議作為我國特有的贍養(yǎng)模式已經(jīng)有著悠久的歷史。但是,由于我國在目前的社會保障的建設(shè)過程中一直關(guān)注的是國家的努力和投入,關(guān)注的是西方模式社會保障體系的建設(shè),而很少有人關(guān)注和探討如何利用我們傳統(tǒng)的家庭贍養(yǎng)模式來構(gòu)建我們自己的社會保障模式。而就傳統(tǒng)家庭贍養(yǎng)模式中的協(xié)議贍養(yǎng)而言,人們已經(jīng)有些淡忘,并在生活中有很多的錯誤認(rèn)識。贍養(yǎng)協(xié)議是指,在父母喪失勞動能力的情況下,贍養(yǎng)人就履行贍養(yǎng)義務(wù)與被贍養(yǎng)人訂立的協(xié)議,或贍養(yǎng)人相互間為分擔(dān)贍養(yǎng)義務(wù)而簽訂的一種協(xié)議。贍養(yǎng)協(xié)議在我們國家之所以能夠有如此堅(jiān)韌的生命力,主要源于我們國家特殊的社會環(huán)境,即小農(nóng)經(jīng)濟(jì)的自然經(jīng)濟(jì)形態(tài)、特殊的家庭結(jié)構(gòu)、儒家“孝”的觀念的約束,等等。贍養(yǎng)父母在法律上雖然是每一個子女的強(qiáng)制性義務(wù),但是在實(shí)際生活中主要落在個父母一同生活的男性后代身上。在簽訂贍養(yǎng)協(xié)議的時候,父母居于比較重要的地位。贍養(yǎng)協(xié)議的內(nèi)容主要是以何種方式來贍養(yǎng)父母。贍養(yǎng)協(xié)議與分家協(xié)議、遺贈扶養(yǎng)協(xié)議是不同類型的協(xié)議。贍養(yǎng)協(xié)議的基本形式是“輪流值養(yǎng)”和“分包父母”。其特點(diǎn)和原則各不相同。并在今日社會有不同形態(tài)的變異。并且出現(xiàn)了委托贍養(yǎng)這種形式的重要變異。 針對我們國家的實(shí)際情況,筆者提出了一些立法建議:1)在刑事立法中,修改刑法虐待罪的刑罰,增加服役社會公益勞動處罰方式,制度化張貼悔過書等制度;2)在民事立法中,鼓勵當(dāng)事人設(shè)立違約金制度,而違約金首先用來保障老人生活,在其過世之后,歸履行義務(wù)一方的人所有;針對第三人的某些行為,提出了增設(shè)精神損害賠償制度。另外,在婚姻法等法律中也提出了些立法意見。除此外,筆者認(rèn)為,在我國目前的最大困難就是法律的貫徹落實(shí)。筆者認(rèn)為我們應(yīng)該明晰化村委的職權(quán),利用村規(guī)民約來貫徹落實(shí)贍養(yǎng)協(xié)議,來指導(dǎo)人們的行為。在處理該類糾紛時候,我們充分利用社會上各種積極力量,要注重調(diào)解。贍養(yǎng)協(xié)議制度的建立,無論對我國的立法還是探索社會保障模式都是大有裨益的,值得我們來研究該問題。
[Abstract]:The alimony agreement has a long history as a unique support model in China. However, due to our country's efforts and investment in the process of social security construction at present, it is concerned about the construction of the social security system in the western mode, and few people have to pay attention to the use of our traditional family support. Model to build our own social security model, and in terms of the traditional family support mode, people have forgotten and have a lot of misunderstandings in life. Alimony agreement refers to the agreement, or support of alimony and the dependents in the case of the loss of the ability of the parents. An agreement between people to share the duty of alimony. The support agreement has such a strong vitality in our country, mainly from the special social environment in our country, that is, the natural economic form of the small peasant economy, the special family structure, the restriction of the Confucian "filial piety", and so on. Although it is the compulsory duty of every child, it falls mainly on the male offspring of the parents who live together in the real life. When the support agreement is signed, the parents are in a more important position. The main content of the support agreement is to support the parents. The support agreement and the branch agreement, the legacy support agreement are Different types of agreements. The basic forms of alimony agreements are "rotation value raising" and "parenting parents". Their characteristics and principles are different. There are different forms of variation in today's society. And important variations in the form of entrusting support have emerged.
In view of the actual situation of our country, the author puts forward some legislative proposals: 1) in the criminal legislation, it is necessary to modify the punishment of the crime of abuse of criminal law, to increase the punishment of public service in the service of the social service, to institutionalize the system of penitent books and so on; and 2) to encourage the parties to establish a system of breach of contract in the civil legislation, and the liquidated damages are first used to guarantee the life of the elderly, After the death of the party, the person who has returned to the obligation to fulfill the obligation is all. In view of some behavior of the third people, the system of compensation for compensation for mental damage is put forward. In addition, some legislative opinions have been put forward in the law of marriage law. In addition, the author thinks that the biggest difficulty in our country is the implementation of the law. The authority of the village committee uses the village rules and regulations to carry out the support agreement to guide the people's behavior. In dealing with the disputes, we make full use of various active forces in the society and pay attention to mediation. The establishment of the support agreement system is of great benefit to both the legislation of our country and the mode of exploring the social security. It is worth studying. Look into the problem.
