【摘要】：和離指夫妻雙方因情意不協(xié)而自愿離婚的制度,它與七出、義絕共同構(gòu)成中國古代法上的離婚制度。和離之制淵源于《周禮》,自唐代始進(jìn)入法典,形成正式制度,后代基本相沿不變。該制強(qiáng)調(diào)婚姻的兩相情愿,不受外力強(qiáng)制的特性。它廣泛應(yīng)用于一般民眾,但對宗室成員和官員有不同程度的限制。考察現(xiàn)有案例可見,和離之法對保護(hù)女方平等的離婚意愿及女方的財(cái)產(chǎn)都有一定價(jià)值,但司法過程中表現(xiàn)出的對女方離婚訴求的抑制也反映出中國古代禮法結(jié)合、維護(hù)家族利益的特點(diǎn)。
[Abstract]:The system of voluntary divorce between husband and wife because of discord, which, together with the seven, constitutes the divorce system in ancient Chinese law. The system of separation originated from Zhou Li, entered into the code from the Tang Dynasty, formed the formal system, and the future generations basically remained the same. The system emphasizes the nature of marriage as being two-sided and not forced by external forces. It is widely used in the general public, but has varying degrees of restrictions on clan members and officials. It can be seen from the existing cases that the law of divorce and the law of divorce are of some value to the protection of the equal will of the woman and the property of the woman, but the suppression of the divorce claim of the woman in the judicial process also reflects the combination of ancient Chinese etiquette and law. The characteristics of safeguarding the interests of the family.
