【摘要】：面對日益嚴(yán)重的具有潛在污染性的產(chǎn)品和包裝造成的環(huán)境污染,我國缺乏對其回收利用和安全處置的法律機(jī)制,為此,需要構(gòu)建我國環(huán)境押金制度以防治由廢棄產(chǎn)品造成的環(huán)境污染。環(huán)境押金制度是指對具有潛在污染的產(chǎn)品(包括其包裝)在銷售時征收一定的押金,如果通過回收這些產(chǎn)品或把它們的殘余物送到指定的回收系統(tǒng)后達(dá)到了避免污染的目的,就將押金返還給被征收者,否則就將其作為治理污染的費用。環(huán)境押金制度借用了普通押金制度的概念、形式和運作機(jī)制,但從法律性質(zhì)上講,其主體和主體間的權(quán)利(力)義務(wù)內(nèi)容已超出了民事法律的范疇,契合了環(huán)境法的公法性質(zhì)。通過環(huán)境押金與環(huán)境稅、環(huán)境基金和環(huán)境保險這三大環(huán)境經(jīng)濟(jì)手段的比較分析可知,環(huán)境押金制度在環(huán)境污染的預(yù)防和資源的循環(huán)利用上有其獨特的制度優(yōu)勢。在理論基礎(chǔ)方面,環(huán)境外部性理論和生產(chǎn)者責(zé)任延伸原則為環(huán)境押金制度的構(gòu)建提供了堅實的理論基礎(chǔ)。在制度應(yīng)用方面,環(huán)境押金制度在西方國家應(yīng)用廣泛,并在預(yù)防固體廢物污染方面獲得了極大的成功。德國、瑞典和美國的環(huán)境押金制度在適用范圍、押金收取返還機(jī)構(gòu)的確定、回收系統(tǒng)的構(gòu)建與運行方式、政府監(jiān)管、押金系統(tǒng)運行費用來源等方面各具特色,對我國的環(huán)境押金制度構(gòu)建具有借鑒作用。另外,構(gòu)建我國環(huán)境押金制度有其必要性和可行性。我國環(huán)境污染和廢物利用的現(xiàn)狀以及現(xiàn)行法律制度中固體廢物的處置回收落實機(jī)制的缺乏使得構(gòu)建我國的環(huán)境押金制度成為必要。構(gòu)建我國環(huán)境押金制度的可行性體現(xiàn)在：構(gòu)建我國環(huán)境押金制度有政策依據(jù)和現(xiàn)實基礎(chǔ)；環(huán)境押金制度本身的經(jīng)濟(jì)合理性；環(huán)境押金制度的弊端能通過政策選擇予以規(guī)避。因此,借鑒國外經(jīng)驗,根據(jù)我國實際情況,環(huán)境押金制度的構(gòu)建可以從以下四個方面著手：環(huán)境押金制度的的立法模式的選擇、環(huán)境押金制度的原則的確立、環(huán)境押金制度的具體內(nèi)容和環(huán)境押金制度的配套制度。
[Abstract]:In the face of increasingly serious environmental pollution caused by potentially polluting products and packaging, China lacks legal mechanisms for its recycling and safe disposal. It is necessary to construct environmental deposit system to prevent and cure environmental pollution caused by discarded products. An environmental deposit system refers to the imposition of a deposit on the sale of potentially polluting products, including their packaging, if the purpose of avoiding pollution is achieved by recycling these products or sending their residues to a designated recovery system, The deposit will be returned to the levy, or it will be the cost of pollution control. The environmental deposit system borrows the concept, form and operation mechanism of the ordinary deposit system, but from the legal nature, the content of the rights (force) obligation between the subject and the subject has gone beyond the scope of civil law, which accords with the nature of public law of environmental law. Through the comparative analysis of environmental deposit and environmental tax, environmental fund and environmental insurance, it can be seen that the environmental deposit system has its unique institutional advantages in the prevention of environmental pollution and the recycling of resources. On the theoretical basis, the environmental externality theory and the extended principle of producer responsibility provide a solid theoretical basis for the construction of environmental deposit system. In the aspect of system application, environmental deposit system has been widely used in western countries, and has been a great success in the prevention of solid waste pollution. The environmental deposit system in Germany, Sweden and the United States has its own characteristics in terms of the scope of application, the determination of the deposit collection and return agencies, the construction and operation of the recovery system, government supervision, and the source of operating expenses for the deposit system. It can be used for reference to the construction of environmental deposit system in China. In addition, the construction of environmental deposit system has its necessity and feasibility. The current situation of environmental pollution and waste utilization in our country and the lack of mechanism of solid waste disposal and recovery in the current legal system make it necessary to set up an environmental deposit system in our country. The feasibility of constructing the environmental deposit system of our country is reflected in the following aspects: the policy basis and the realistic basis for the construction of the environmental deposit system in China; the economic rationality of the environmental deposit system itself; and the drawbacks of the environmental deposit system can be avoided through the policy choice. Therefore, drawing lessons from foreign experience, according to the actual situation of our country, the construction of the environmental deposit system can be started from the following four aspects: the choice of the legislative model of the environmental deposit system, the establishment of the principles of the environmental deposit system, The specific contents of the environmental deposit system and the supporting system of the environmental deposit system.
