【摘要】:在長期的歷史進(jìn)程中,人類在發(fā)展經(jīng)濟(jì)的同時,也出現(xiàn)了對森林資源的過度開發(fā)和利用。隨著生態(tài)環(huán)境的惡化,人們對森林資源的經(jīng)濟(jì)價值和生態(tài)價值也有了更加深刻的認(rèn)識,對森林資源的保護(hù)也越發(fā)重視。森林資源生態(tài)補(bǔ)償制度是保護(hù)森林資源的重要法律制度,也是本文要研究的內(nèi)容。本文通過四個部分對該制度進(jìn)行探討。 第一部分是對森林資源生態(tài)補(bǔ)償法律制度的分析。首先,本文認(rèn)為要從多角度對生態(tài)補(bǔ)償?shù)母拍钸M(jìn)行探討,然后延伸得出森林資源生態(tài)補(bǔ)償?shù)母拍。其?對國外的森林資源生態(tài)補(bǔ)償法律制度進(jìn)行分析和比較,同時對我國在建立森林資源生態(tài)補(bǔ)償法律制度方面的成績予以歸納總結(jié)。通過對國內(nèi)外森林生態(tài)補(bǔ)償法律制度的分析,為下一步提出構(gòu)建我國森林生態(tài)補(bǔ)償法奠定基礎(chǔ)。 第二部分是從生態(tài)學(xué)、經(jīng)濟(jì)學(xué)、法學(xué)等多個角度分析了我國森林資源生態(tài)補(bǔ)償法律制度的理論基礎(chǔ),為下一步探討完善我國森林生態(tài)補(bǔ)償法律制度提供正確、充分的理論依據(jù)。 第三部分,分析我國森林生態(tài)補(bǔ)償法律制度在四個方面存在不足。第一個不足表現(xiàn)在立法指導(dǎo)思想方面,即現(xiàn)行森林生態(tài)補(bǔ)償法律制度缺乏生態(tài)價值觀做為立法指導(dǎo)思想。第二個不足是我國缺乏規(guī)范的林業(yè)產(chǎn)權(quán)制度。由于林業(yè)產(chǎn)權(quán)直接關(guān)系到對森林資源的開發(fā)、經(jīng)營、管理和利益歸屬問題,因此明晰的林業(yè)產(chǎn)權(quán)與森林資源生態(tài)補(bǔ)償?shù)捻樌_展息息相關(guān)。第三個不足是我國森林生態(tài)補(bǔ)償制度法律體系結(jié)構(gòu)不平衡!董h(huán)境保護(hù)法》等對森林生態(tài)補(bǔ)償?shù)膬?nèi)容沒有明確規(guī)定。從立法層次上講,從環(huán)境保護(hù)基本法到森林資源單行法對森林生態(tài)補(bǔ)償?shù)囊?guī)定還沒有形成完整的法律體系。第四個不足就是森林生態(tài)補(bǔ)償?shù)膬?nèi)容還有很多需要改進(jìn)和完善的地方。 第四個部分,從四個方面提出構(gòu)建森林生態(tài)補(bǔ)償法的建議。首先,指出我國建立森林資源生態(tài)補(bǔ)償法的必要性。其次,提出樹立生態(tài)價值觀作為森林生態(tài)補(bǔ)償法的立法指導(dǎo)思想。第三,對森林生態(tài)補(bǔ)償法內(nèi)容的建議,這包括建立和完善補(bǔ)償原則、補(bǔ)償對象、補(bǔ)償標(biāo)準(zhǔn)、補(bǔ)償渠道及補(bǔ)償基金籌集的相關(guān)規(guī)定及后續(xù)監(jiān)管措施。最后,提出要使森林生態(tài)補(bǔ)償制度順利運(yùn)行,還必須修訂與該法律制度相關(guān)的其他制度,以保證森林生態(tài)補(bǔ)償工作的開展有一個良好的制度環(huán)境,這些制度包括森林資源產(chǎn)權(quán)制度、價格制度和綠色GDP制度等等。只有通過這些制度的完善和運(yùn)行,我國森林生態(tài)補(bǔ)償工作才能持續(xù)、平穩(wěn)地開展。
[Abstract]:In the long history process, the human being develops the economy, but also appears the over-exploitation and the utilization of the forest resources. With the deterioration of ecological environment, people also have a deeper understanding of the economic and ecological value of forest resources, and pay more attention to the protection of forest resources. The ecological compensation system of forest resources is an important legal system to protect forest resources. This article carries on the discussion to this system through four parts. The first part is the analysis of the legal system of ecological compensation of forest resources. Firstly, the concept of ecological compensation should be discussed from various angles, and then the concept of ecological compensation of forest resources should be derived. Secondly, it analyzes and compares the foreign legal system of ecological compensation of forest resources, and summarizes the achievements of establishing the legal system of ecological compensation of forest resources in China. By analyzing the legal system of forest ecological compensation at home and abroad, this paper lays a foundation for the construction of forest ecological compensation law in China. The second part analyzes the theoretical basis of the ecological compensation legal system of forest resources from the perspectives of ecology, economics, law and so on, and provides a correct and sufficient theoretical basis for the further exploration and improvement of the legal system of forest ecological compensation in China. The third part, analyzes the forest ecological compensation legal system in four aspects. The first one is the legislative guiding ideology, that is, the current legal system of forest ecological compensation lacks ecological values as the guiding ideology of legislation. The second deficiency is the lack of standardized forestry property right system in our country. Since forestry property right is directly related to the exploitation, management, management and interest attribution of forest resources, the clear forestry property right is closely related to the smooth development of forest resources ecological compensation. The third deficiency is the imbalance of the legal system of forest ecological compensation system in China. The contents of forest ecological compensation are not clearly stipulated in the Environmental Protection Law. From the legislative level, there is no complete legal system from the basic law of environmental protection to the regulation of forest ecological compensation by forest resources law. The fourth deficiency is the forest ecological compensation content and a lot of need to be improved and improved. The fourth part, from four aspects, put forward the construction of forest ecological compensation law. Firstly, it points out the necessity of establishing ecological compensation law of forest resources in China. Secondly, set up ecological values as the legislative guiding ideology of forest ecological compensation law. Third, the content of the forest ecological compensation law, which includes the establishment and improvement of compensation principles, compensation objects, compensation standards, compensation channels and compensation fund related provisions and subsequent regulatory measures. Finally, it is proposed that in order to make the forest ecological compensation system run smoothly, it is necessary to revise other systems related to the legal system so as to ensure a good institutional environment for the development of forest ecological compensation. These systems include forest resource property right system, price system and green GDP system and so on. Only through the perfection and operation of these systems can the forest ecological compensation work in China be carried out continuously and smoothly.
