【摘要】：環(huán)境糾紛是隨著經濟發(fā)展和公民環(huán)保意識的增強而出現(xiàn)一種現(xiàn)代型糾紛。傳統(tǒng)的私權自治理論認為,民事糾紛應當由當事人自由處分,行政權力不得過多干涉。因此,介入私人糾紛一直是行政權所極力回避的事情。但是,環(huán)境糾紛是一種關系到廣泛區(qū)域中不特定多數(shù)人利益的社會問題,需要基于專業(yè)知識的判斷加以解決。因此,在解決環(huán)境民事糾紛時,掌握較多社會資源的行政機關的積極協(xié)助就顯得十分必要。 本文分為引言、正文、結語三個部分。正文分為四章,第一章從環(huán)境民事糾紛的基本問題出發(fā),介紹了環(huán)境民事糾紛的概念,簡述了環(huán)境民事糾紛的解決機制的基本問題,并分析了環(huán)境民事糾紛行政處理的正當性。 第二章著重介紹了環(huán)境民事糾紛解決機制較為發(fā)達的國家,在環(huán)境民事糾紛行政處理機制和民事訴訟的關系問題上所采用的模式,為我國關系模式的研究奠定基礎。 第三章在對我國環(huán)境民事糾紛行政處理機制與訴訟機制的關系模式進行闡釋的同時,提出了構建我國環(huán)境民事糾紛的行政處理機制與現(xiàn)行訴訟機制之間的關系模式中待解決的問題。 第四章在完善我國環(huán)境民事糾紛行政處理機制的基礎上,提出了環(huán)境民事糾紛行政解決機制與訴訟機制的關系的新模式,即程序選擇且不可并行、行政裁決有強制力、行政調解經合法審查有效的關系模式,以及此種模式的具體制度構建問題。
[Abstract]:Environmental dispute is a kind of modern dispute with the development of economy and the enhancement of citizen's consciousness of environmental protection. The traditional private right autonomy theory holds that civil disputes should be disposed of freely by the parties, and administrative power should not interfere too much. Therefore, the intervention in private disputes has always been the administrative power to avoid the matter. However, environmental disputes are a kind of social problems related to the interests of non-specific majority in a wide range of regions, which need to be resolved based on the judgment of professional knowledge. Therefore, it is necessary to solve environmental civil disputes with the help of administrative organs with more social resources. This paper is divided into three parts: introduction, text and conclusion. The text is divided into four chapters. The first chapter introduces the concept of environmental civil disputes from the basic problems of environmental civil disputes, briefly describes the basic problems of environmental civil disputes resolution mechanism, and analyzes the legitimacy of environmental civil disputes administrative processing. The second chapter focuses on the environmental civil dispute settlement mechanism developed countries in the environmental civil dispute administrative handling mechanism and civil litigation in the relationship between the use of the model for China to lay a foundation for the study of the relationship model. The third chapter explains the relationship between administrative mechanism and litigation mechanism of environmental civil disputes in China, at the same time, The problems to be solved in the relationship between the administrative handling mechanism of environmental civil disputes and the current litigation mechanism in China are put forward. Chapter four, on the basis of perfecting the administrative handling mechanism of environmental civil disputes in our country, puts forward a new model of the relationship between the administrative settlement mechanism of environmental civil disputes and the litigation mechanism, that is, the procedure choice is not parallel, and the administrative adjudication has the force of enforcement. Administrative mediation through legal examination of the effective relationship model, as well as the specific system construction of this model.
