【摘要】： 近幾十年,隨著工農(nóng)業(yè)的蓬勃發(fā)展和人口的增多、海洋運輸和海洋開發(fā)技術的進步、大批港口和城市的興起與擴建,大量有毒有害物質傾倒于海洋,使海洋資源受到了嚴重的污染、海洋環(huán)境受到威脅。海洋對人類生存和社會發(fā)展的重要意義以及日益加劇的海洋環(huán)境污染,促使整個國際社會認識到保護海洋環(huán)境的重要性和緊迫性。針對越來越嚴重的海洋傾廢現(xiàn)象,國際社會和各國政府都開始采取措施,最大限度地減少或防止海洋傾廢對海洋環(huán)境的影響,保護和保全海洋環(huán)境。 我國是一個發(fā)展中的沿海大國,但隨著社會的發(fā)展,我國的海洋環(huán)境特別是海洋傾廢問題日益突出。盡管我國政府采取了一系列的措施加以整治,初步形成了具有中國特色的海洋傾廢法律、管理體系,但與目前國際海洋傾廢制度的發(fā)展狀況相比還有較大差距。因此,本文擬從海洋傾廢的基本理論、國際海洋傾廢制度的發(fā)展歷程、國內(nèi)海洋傾廢法律制度存在的問題入手,對我國借鑒國際海洋傾廢制度的必要性、國際海洋傾廢法律制度對我國產(chǎn)生的影響進行理論分析,通過對比發(fā)現(xiàn)我國海洋傾廢法律制度存在的問題,并對如何完善我國海洋傾廢法律制度提出一整套建設性的意見,以期對我國海洋傾廢法律制度的健全有所裨益。
[Abstract]:In recent decades, with the vigorous development of industry and agriculture and the increase of population, the progress of marine transportation and marine development technology, the rise and expansion of a large number of ports and cities, a large number of toxic and harmful substances have been dumped into the sea.The marine resources are seriously polluted and the marine environment is threatened.The importance of the ocean to the survival and social development of mankind and the increasing pollution of the marine environment urge the whole international community to realize the importance and urgency of protecting the marine environment.In response to the increasingly serious phenomenon of ocean dumping, the international community and governments have begun to take measures to minimize or prevent the impact of ocean dumping on the marine environment and to protect and preserve the marine environment.China is a developing coastal country, but with the development of society, the marine environment, especially marine dumping, is becoming more and more prominent.Although the Chinese government has taken a series of measures to rectify the marine dumping law and management system with Chinese characteristics, there is still a big gap compared with the current development of the international marine dumping system.Therefore, this paper intends to start with the basic theory of ocean dumping, the development course of international ocean dumping system, the problems existing in domestic marine dumping legal system, and the necessity for our country to draw lessons from international ocean dumping system.This paper makes a theoretical analysis of the influence of the international marine dumping legal system on our country, finds out the problems existing in our country's marine dumping legal system, and puts forward a set of constructive opinions on how to perfect our country's marine dumping legal system.In order to improve the legal system of ocean dumping in China.
