【摘要】："兩法銜接"不暢,行政執(zhí)法主體不具備刑事訴訟的取證主體資格是一個(gè)重要因素,該問題放到具體的行政執(zhí)法領(lǐng)域具體分析就會發(fā)現(xiàn)更多實(shí)際難題。在環(huán)境執(zhí)法與環(huán)境刑事司法銜接領(lǐng)域即存在以下問題:從刑事取證司法壟斷的邏輯上看環(huán)境監(jiān)察部門不是適格主體;從立案前取證的效力理論邏輯上看環(huán)境保護(hù)機(jī)關(guān)的取證資格亦不成立。從體制上看,要從根本上解決"兩法銜接"難題有賴于打破集中式偵查權(quán)配置的格局,賦予行政執(zhí)法機(jī)關(guān)以部分刑事偵查權(quán)。同時(shí),在取證規(guī)范上也須做出修改,即所有行政執(zhí)法中的取證行為都應(yīng)根據(jù)刑事訴訟法的取證規(guī)范進(jìn)行。
[Abstract]:The connection between the two laws is not smooth and the subject of administrative law enforcement does not possess the qualification of the subject of obtaining evidence in criminal proceedings. It is an important factor that the problem is analyzed in the specific field of administrative law enforcement and more practical problems will be found.In the field of environmental law enforcement and environmental criminal justice, there are the following problems: from the logic of judicial monopoly of criminal evidence, the environmental supervision department is not the appropriate subject;From the theory of validity of evidence before filing, the qualification of environmental protection organization is not established.From the system point of view, the fundamental solution to the problem of "convergence of two laws" depends on breaking the pattern of centralized investigation power allocation and endowing administrative law enforcement organs with part of criminal investigation power.At the same time, it is necessary to modify the rules of evidence collection, that is, all the acts of evidence collection in administrative law enforcement should be carried out according to the rules of criminal procedure law.
