【摘要】： 生態(tài)安全是一切安全中的“底座安全”,甚至關(guān)系到整個(gè)國(guó)家的安危存亡。目前我國(guó)生態(tài)安全問題頻發(fā),安全態(tài)勢(shì)十分嚴(yán)峻。但由于我國(guó)生態(tài)安全的理論研究尚處于起步階段,而我國(guó)的生態(tài)安全法律制度也存在著嚴(yán)重的滯后與不足。因此迫切需要進(jìn)行有關(guān)生態(tài)安全立法研究,尤其是有關(guān)生態(tài)安全法律制度的研究,從而推動(dòng)我國(guó)生態(tài)安全立法工作,切實(shí)維護(hù)我國(guó)的生態(tài)安全。 通過運(yùn)用比較研究方法、價(jià)值分析方法以及多學(xué)科交叉的方法對(duì)生態(tài)安全的概念和內(nèi)涵進(jìn)行深入探討,分析了我國(guó)的生態(tài)安全問題及成因,并進(jìn)一步揭示我國(guó)生態(tài)安全立法問題與成因,從而提出我國(guó)生態(tài)安全法律制度體系的價(jià)值追求、目的、指導(dǎo)思想、基本原則、框架,并對(duì)我國(guó)主要生態(tài)安全法律制度的構(gòu)建進(jìn)行了初步探討。 首先,通過對(duì)生態(tài)安全的由來、生態(tài)安全的法律定義與特征、生態(tài)安全與其它安全的關(guān)系以及生態(tài)安全與風(fēng)險(xiǎn)理論和安全科學(xué)理論的關(guān)系進(jìn)行探討來把握生態(tài)安全的概念和內(nèi)涵,從而為生態(tài)安全法律制度的構(gòu)建奠定概念基礎(chǔ)。通過對(duì)我國(guó)生態(tài)安全問題及我國(guó)生態(tài)安全立法現(xiàn)狀與缺失的深入分析,指出我國(guó)存在的七類生態(tài)安全問題及其成因,剖析目前我國(guó)生態(tài)安全立法現(xiàn)狀和存在的五大問題,并從倫理基礎(chǔ)、指導(dǎo)思想和理論基礎(chǔ)、法律轉(zhuǎn)換等層面探討造成我國(guó)生態(tài)安全立法問題的深層原因。 接著,通過對(duì)我國(guó)生態(tài)安全法律制度的價(jià)值追求、目的、指導(dǎo)思想以及我國(guó)生態(tài)安全法律制度應(yīng)該遵循原則的深入考察,指出我國(guó)生態(tài)安全法律制度的價(jià)值追求應(yīng)是以生態(tài)安全為主導(dǎo),實(shí)現(xiàn)生態(tài)安全、社會(huì)安全二者的統(tǒng)一;生態(tài)安全法律制度的立法目的則直接表現(xiàn)為保障生態(tài)系統(tǒng)的安全,從而實(shí)現(xiàn)生態(tài)系統(tǒng)包括人類社會(huì)在內(nèi)的可持續(xù)性發(fā)展;提出生態(tài)安全法律制度應(yīng)以實(shí)現(xiàn)生態(tài)安全利益和社會(huì)經(jīng)濟(jì)利益的統(tǒng)一作為基本指導(dǎo)思想并貫徹預(yù)防和合作的思想;并指出我國(guó)生態(tài)安全法律制度體系的七個(gè)基本原則:(1)可持續(xù)發(fā)展原則;(2)公平原則;(3)持續(xù)性原則;(4)協(xié)調(diào)性原則;(5)資源價(jià)值原則;(6)公眾參與原則;(7)謹(jǐn)慎原則。在上述指導(dǎo)思想和基本原則的指導(dǎo)下提出我國(guó)生態(tài)安全法律制度體系框架包括七個(gè)制度,并對(duì)其中四個(gè)主要的生態(tài)安全法律制度進(jìn)行設(shè)計(jì)、補(bǔ)充、完善:(1)生態(tài)安全評(píng)價(jià)制度;(2)生態(tài)安全補(bǔ)償制度;(3)生態(tài)安全特定保護(hù)區(qū)制度;(4)生態(tài)事故事件應(yīng)急制度。
[Abstract]:Ecological security is the "base security" of all security, even related to the safety and death of the whole country. At present, the ecological security problems occur frequently in our country, and the security situation is very serious. However, the theoretical research on ecological security in China is still in its infancy. However, the legal system of ecological security in our country also has serious lag and deficiency. Therefore, it is urgent to carry out the research on the legislation of ecological security, especially on the legal system of ecological security, so as to promote the legislation of ecological security in our country. We will earnestly safeguard the ecological security of our country. By using comparative research method, value analysis method and multidisciplinary method, the concept and connotation of ecological security are discussed in depth, and the problems and causes of ecological security in China are analyzed. Furthermore, it reveals the legislative problems and causes of ecological security in China, and puts forward the value pursuit, purpose, guiding ideology, basic principles and framework of the legal system of ecological security in China. At the same time, the construction of the main ecological security legal system in China is discussed. First of all, through the origin of ecological security, the legal definition and characteristics of ecological security, The relationship between ecological security and other security, and the relationship between ecological security and risk theory and safety science theory are discussed to grasp the concept and connotation of ecological security. Through the deep analysis of the problems of ecological security in our country and the current situation and lack of ecological security legislation, this paper points out seven kinds of ecological security problems and their causes of formation in our country. This paper analyzes the present situation and five problems of ecological security legislation in China, and probes into the deep causes of the legislative problems of ecological security in China from the aspects of ethical basis, guiding ideology and theoretical basis, legal transformation and so on. Then, through the in-depth investigation of the value pursuit, purpose, guiding ideology and the principles of our country's ecological security legal system, It is pointed out that the value pursuit of our country's ecological security legal system should be based on ecological security, realizing the unity of ecological security and social security, while the legislative purpose of the legal system of ecological security is to guarantee the safety of ecological system. In order to realize the sustainable development of the ecosystem including human society, it is proposed that the legal system of ecological security should take the unity of ecological security interests and social and economic interests as the basic guiding ideology and carry out the idea of prevention and cooperation. It is also pointed out that the seven basic principles of the legal system of ecological security in China are: 1) Sustainable development principle 2) equity principle 3) persistence principle 5) Resource value principle 6) Public participation principle 7) caution principle. Under the guidance of guiding ideology and basic principles, it is proposed that the legal system framework of ecological security in China includes seven systems. Four of the main ecological security legal systems are designed to complement and perfect the ecological security evaluation system (1) ecological security evaluation system (2) ecological security compensation system (3) the ecological security special protection area system and (4) the ecological accident emergency system.
