【摘要】： 我國農村生活水平和農村生產力的日益提高,農村固體廢棄物無論是種類還是數量上都比過去有了很大的增長。但是我國對于農村固體廢物污染的防治并沒有大的提升,而且缺少相關法律法規(guī)來規(guī)范和促進防治工作的進行,導致農村環(huán)境和農村居民健康遭受了嚴重的損害。目前,我國農村固體廢物污染防治的法制建設在指導思想、基本原則、法律制度以及監(jiān)管體制上都有一定的發(fā)展,雖然在長期的治理過程中積累了一定的經驗,但是還是有很多不完善的地方。例如,農村固體廢物的概念界定不明確,相關的專門性法律法規(guī)缺位,基層固體廢物污染防治管理體制不順,農村固體廢物污染放置法律制度不完善。寫作本文的目的,就是希望通過對農村固體廢物污染的現狀和國內外相關法律制度的分析探討,為完善我國農村固體廢物污染防治的法律制度提供一些有益的建議。 本文首先分析了農村固體廢物的概念,簡要介紹了農村固體廢物的種類,并分析了農村固體廢物的特點是數量大、成分雜、面積廣、污染對象立體化。然后,本文對農村固體廢物污染現狀做了介紹,并簡要分析了農村固體的污染原因分析。第三章介紹了國外發(fā)達國家關于農村固體廢物污染防治的立法狀況,并選取日本、美國和德國三個典型的例子,通過比較國外的先進立法經驗,總結出我國完善相關立法應當借鑒的地方。之后在第四章中筆者介紹了我國關于農村固體廢物污染環(huán)境防治的立法現狀,包括了固體廢物污染防治的基本法、專門性法律法規(guī)、國務院行政法規(guī)和中央政策、部門規(guī)章和地方性法規(guī)規(guī)章以及其他相關規(guī)定,并分析總結了我國農村固體廢物污染環(huán)境防治法律制度的欠缺。最后本文提出了完善我國農村固體廢物污染環(huán)境防治法律制度的相關建議。
[Abstract]:With the increasing improvement of rural living standards and rural productivity, the amount and variety of solid waste in rural areas have greatly increased compared with the past. However, the prevention and control of solid waste pollution in rural areas has not been greatly improved in China. Moreover, the lack of relevant laws and regulations to standardize and promote the prevention and control work has caused serious damage to the rural environment and the health of rural residents. At present, the legal system for the prevention and control of solid waste pollution in rural areas is under the guiding ideology and basic principles. There has been some development in the legal system as well as in the regulatory system. Although some experience has been accumulated in the long-term governance process, there are still many imperfections. For example, the concept of rural solid waste is not clearly defined. The relevant special laws and regulations are absent, the basic level solid waste pollution prevention and control management system is not good, the countryside solid waste pollution placement legal system is not perfect. It is hoped that through the analysis and discussion of the status quo of the rural solid waste pollution and the related legal systems at home and abroad, some useful suggestions will be provided for the improvement of the legal system for the prevention and control of the rural solid waste pollution in our country. This paper first analyzes the concept of rural solid waste, briefly introduces the types of rural solid waste, and analyzes the characteristics of rural solid waste is large quantity, miscellaneous composition, wide area, three-dimensional pollution object. This paper introduces the status quo of solid waste pollution in rural areas, and briefly analyzes the causes of solid pollution in rural areas. Chapter three introduces the legislation status of rural solid waste pollution prevention and control in developed countries, and selects Japan. Three typical examples of the United States and Germany, through comparison of foreign advanced legislative experience, In the fourth chapter, the author introduces the current situation of our country's legislation on the environmental control of solid waste pollution in rural areas, including the basic law, special laws and regulations of the prevention and control of solid waste pollution. Administrative regulations and central policies of the State Council, departmental and local regulations and other relevant provisions, Finally, this paper puts forward some suggestions on how to improve the legal system of environmental prevention and control of solid waste pollution in rural areas.
