【摘要】：公益林生態(tài)效益市場補(bǔ)償作為公益林生態(tài)效益補(bǔ)償?shù)囊环N新類型,能有效的利用市場手段為公益林生態(tài)效益補(bǔ)償籌集資金,以減輕政府的財(cái)政負(fù)擔(dān),是政府補(bǔ)償?shù)挠行аa(bǔ)充。同時(shí),這也是市場經(jīng)濟(jì)發(fā)展的必然要求。公益林生態(tài)效益市場補(bǔ)償?shù)挠行ч_展,真正的實(shí)現(xiàn)了政府補(bǔ)償機(jī)制與市場補(bǔ)償機(jī)制的有機(jī)結(jié)合,有利于確保公益林生態(tài)效益的持續(xù)供給和整個(gè)生態(tài)系統(tǒng)的安全。我國公益林生態(tài)效益市場補(bǔ)償仍處于初步發(fā)展階段,對(duì)公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的理論研究較少,立法也很不完善。為保障和促進(jìn)公益林生態(tài)效益市場補(bǔ)償?shù)捻樌�、�?guī)范開展,建立一套公益林生態(tài)效益市場補(bǔ)償法律機(jī)制是十分必要的。 本文由四個(gè)部分組成: 第一部分“公益林生態(tài)效益市場補(bǔ)償法律機(jī)制概述”,主要對(duì)公益林生態(tài)效益市場補(bǔ)償、公益林生態(tài)效益市場補(bǔ)償法律關(guān)系和公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的相關(guān)概念進(jìn)行界定與分析,并對(duì)建立公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的重要意義與理論基礎(chǔ)進(jìn)行探討。 第二部分“我國公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的現(xiàn)狀”,從立法和實(shí)踐兩個(gè)層面對(duì)我國公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的現(xiàn)狀進(jìn)行全面、深入的分析,并總結(jié)出我國公益林生態(tài)效益市場補(bǔ)償法律機(jī)制在建立過程中主要遇到的障礙。 第三部分“國外主要國家森林生態(tài)效益市場補(bǔ)償法律機(jī)制及其啟示”,介紹與分析了哥斯達(dá)黎加、美國、巴西和芬蘭等國有關(guān)森林生態(tài)效益市場補(bǔ)償?shù)姆蓹C(jī)制,并對(duì)國外的先進(jìn)經(jīng)驗(yàn)進(jìn)行了比較與總結(jié),以期為我國公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的建立提供有益的參考。 第四部分“構(gòu)建我國公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的建議”,主要從加強(qiáng)立法、明確公益林生態(tài)效益的產(chǎn)權(quán)、構(gòu)建公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的實(shí)施內(nèi)容和法律監(jiān)管機(jī)制等方面,對(duì)我國公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的建立提出一些建議。本文的創(chuàng)新之處在于:一是對(duì)我國公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的現(xiàn)狀進(jìn)行全面、系統(tǒng)的梳理;二是總結(jié)出國外森林生態(tài)效益市場補(bǔ)償法律機(jī)制中可供我國借鑒的寶貴經(jīng)驗(yàn);三是明晰公益林生態(tài)效益的產(chǎn)權(quán),并對(duì)公益林生態(tài)效益市場補(bǔ)償法律機(jī)制的實(shí)施內(nèi)容和法律監(jiān)管機(jī)制等進(jìn)行創(chuàng)新性的構(gòu)建。
[Abstract]:As a new type of compensation for ecological benefit of public welfare forest, market compensation can effectively use market means to raise funds for ecological benefit compensation of public welfare forest, in order to lighten the financial burden of the government. It is an effective supplement to government compensation. At the same time, it is the inevitable requirement of the development of market economy. The effective development of market compensation for ecological benefits of public welfare forest has truly realized the organic combination of government compensation mechanism and market compensation mechanism. It is beneficial to ensure the sustainable supply of ecological benefits of public welfare forests and the safety of the whole ecosystem. The market compensation for ecological benefits of public welfare forests in China is still in the initial stage of development, and there are few theoretical studies on the legal mechanism of market compensation for ecological benefits of public welfare forests. In order to ensure and promote the smooth market compensation of ecological benefit of public welfare forest, it is necessary to establish a set of legal mechanism of market compensation for ecological benefit of public welfare forest. This paper consists of four parts:. The first part is "Overview of the legal mechanism of market compensation for ecological benefits of public welfare forests", which mainly compensates the market for ecological benefits of public welfare forests. The legal relation of market compensation for ecological benefit of public welfare forest and the related concepts of legal mechanism of market compensation for ecological benefit of public welfare forest are defined and analyzed. The important significance and theoretical basis of establishing the legal mechanism of market compensation for ecological benefits of public welfare forest are also discussed. The second part is "the present situation of the legal mechanism of the market compensation for the ecological benefit of the public welfare forest in our country", which makes a comprehensive and in-depth analysis on the present situation of the legal mechanism of the market compensation of the ecological benefit of the public welfare forest in China from the two aspects of legislation and practice. The main obstacles encountered in the process of establishing the legal mechanism of market compensation for ecological benefits of public welfare forest in China are summarized. The third part, "the legal mechanism of forest ecological benefit market compensation in major foreign countries and its enlightenment", introduces and analyzes the legal mechanism of forest ecological benefit market compensation in Costa Rica, the United States, Brazil and Finland, etc. The advanced experiences of foreign countries are compared and summarized in order to provide a useful reference for the establishment of the legal mechanism of market compensation for the ecological benefits of public welfare forests in China. The fourth part, "the suggestion of constructing the legal mechanism of market compensation for ecological benefit of public welfare forest", mainly from strengthening legislation, defining the property right of ecological benefit of public welfare forest. Constructing the implementation content and legal supervision mechanism of market compensation legal mechanism for ecological benefit of public welfare forest, etc. Some suggestions are put forward on the establishment of the legal mechanism of market compensation for ecological benefits of public welfare forests in China. The innovations of this paper are as follows: first, the present situation of the legal mechanism of market compensation for ecological benefits of public welfare forests in China is comprehensively and systematically combed out; The second is to sum up the valuable experience that can be used for reference by our country in the legal mechanism of market compensation for forest ecological benefits in foreign countries, and the third is to clarify the property rights of ecological benefits of public welfare forests. And the implementation content and legal supervision mechanism of market compensation legal mechanism of ecological benefit of public welfare forest are innovatively constructed.
