【摘要】： 隨著動物福利理念的推廣和消費(fèi)者消費(fèi)意識的轉(zhuǎn)變,農(nóng)場動物的福利狀況日漸受到越來越多的人們關(guān)注。許多國家已經(jīng)制定了較為完善的農(nóng)場動物福利法,并且許多國際組織也給予了農(nóng)場動物較大的關(guān)注,制定了國際通用的標(biāo)準(zhǔn)、準(zhǔn)則和建議。而與此形成鮮明對比的是,我國農(nóng)場動物保護(hù)起步較晚,許多方面還存在缺陷。特別是我國加入世貿(mào)組織后,面對動物福利極有可能成為一道新的貿(mào)易壁壘的現(xiàn)實,而我國還沒有相應(yīng)的法律規(guī)定。本課題的研究旨在通過探討我國目前農(nóng)場動物福利理論與實踐領(lǐng)域存在的問題,并借鑒國外先進(jìn)的立法經(jīng)驗,為我國農(nóng)場動物福利立法探索出有益、可行的道路,以促進(jìn)我國農(nóng)場動物福利立法早日實現(xiàn),達(dá)到現(xiàn)代社會經(jīng)濟(jì)效益、生態(tài)效益和社會效益協(xié)調(diào)統(tǒng)一的目的。 首先,本文通過動物福利的內(nèi)涵引申出農(nóng)場動物福利的主題,并對農(nóng)場動物、農(nóng)場動物福利的內(nèi)涵進(jìn)行闡述。通過對我國農(nóng)場動物福利保護(hù)方面法律的查閱,發(fā)現(xiàn)我國目前沒有專門的農(nóng)場動物福利立法,相關(guān)的法律、法規(guī)存在很多問題,如：我國現(xiàn)行的有關(guān)動物保護(hù)的法律法規(guī)數(shù)量較少,尚未形成一個完整的體系；立法目的落后,缺失動物福利理念；法律、法規(guī)原則性規(guī)定較多,覆蓋面小,可操作性差；法律責(zé)任不嚴(yán)格；監(jiān)管體制和監(jiān)管機(jī)制不順等等。正因為如此,我國農(nóng)場動物的福利狀況令人擔(dān)憂,如動物注水問題、動物疫病情況嚴(yán)重、屠宰方式野蠻等等殘酷對待農(nóng)場動物的做法比比皆是。因此,文章通過對我國農(nóng)場動物福利立法必要性和可行性的探討,認(rèn)為在我國完善農(nóng)場動物福利法的時機(jī)已經(jīng)成熟。在文章的最后一部分,對完善我國農(nóng)場動物福利立法提出了建議,我國可以先對相關(guān)的法律法規(guī)予以修改完善,在適當(dāng)?shù)臅r候制定專門的農(nóng)場動物福利法,并對該法從立法模式、立法目的、基本制度、法律責(zé)任和監(jiān)管機(jī)制等方面做出了初步的構(gòu)想,同時表達(dá)了對我國農(nóng)場動物福利法立法美好前景的期待。
[Abstract]:With the popularization of animal welfare concept and the change of consumer's consumption consciousness, more and more people pay attention to the welfare status of farm animals. Many countries have formulated more perfect farm animal welfare laws. And many international organizations have paid more attention to farm animals and formulated international standards, guidelines and recommendations. By contrast, the protection of farm animals in China started relatively late. There are still shortcomings in many aspects. In particular, after China's accession to the WTO, animal welfare is likely to become a new trade barrier. However, there are no corresponding legal provisions in our country. The purpose of this study is to explore the problems in the field of farm animal welfare theory and practice in China, and to learn from the advanced legislative experience of foreign countries. To explore a beneficial and feasible way for the legislation of farm animal welfare in our country, in order to promote the early realization of farm animal welfare legislation in China, and to achieve the goal of coordinating and unifying the economic benefits, ecological benefits and social benefits of modern society. First of all, this paper generalizes the theme of farm animal welfare through the connotation of animal welfare, and expounds the connotation of farm animal and farm animal welfare. It is found that there is no special legislation on farm animal welfare in our country at present. There are many problems in the relevant laws and regulations, such as: the number of laws and regulations on animal protection in our country is relatively small, yet a complete system has not been formed, the legislative purpose is backward, Lack of animal welfare concept; more laws and regulations in principle, small coverage, poor maneuverability; lax legal liability; bad regulatory system and regulatory mechanism; and so on. Because of this, the welfare of farm animals in our country is worrying. For example, the problem of animal water injection, the serious situation of animal epidemic, the cruelty of slaughtering and other cruel treatment of farm animals are everywhere. Therefore, the article discusses the necessity and feasibility of farm animal welfare legislation in China. In the last part of the article, some suggestions are put forward to perfect the legislation of farm animal welfare in our country, and the relevant laws and regulations can be amended and perfected in our country. At the appropriate time, a special farm animal welfare law was formulated, and a preliminary idea was made on the legislative model, the legislative purpose, the basic system, the legal responsibility and the regulatory mechanism, etc. At the same time, it expresses the expectation of the legislation of farm animal welfare law in our country.
