【摘要】： 我國(guó)目前面臨著嚴(yán)峻的環(huán)境資源問(wèn)題,建設(shè)資源節(jié)約型社會(huì)是我國(guó)解決環(huán)境資源問(wèn)題、實(shí)現(xiàn)可持續(xù)發(fā)展的必然選擇。山西省作為全國(guó)最大的能源與重化工生產(chǎn)基地,資源賦存相對(duì)豐富。然而,隨著經(jīng)濟(jì)的快速發(fā)展,粗放型、高耗費(fèi)的經(jīng)濟(jì)開(kāi)發(fā)方式使得資源的約束矛盾日益凸顯,所以構(gòu)建資源節(jié)約型社會(huì)勢(shì)在必行。要實(shí)現(xiàn)這一目標(biāo)就需要有與之相配套的法律法規(guī)來(lái)支撐和保障。本文首先對(duì)山西目前建設(shè)資源節(jié)約型社會(huì)的法律現(xiàn)狀進(jìn)行了分析并指出其中存在的法律問(wèn)題,接著總結(jié)了國(guó)外建設(shè)資源節(jié)約型社會(huì)法律方面的成功經(jīng)驗(yàn),最后通過(guò)借鑒國(guó)外的成功經(jīng)驗(yàn)來(lái)完善山西建設(shè)資源節(jié)約型社會(huì)的相關(guān)法律問(wèn)題。 本文包括引言、正文和結(jié)語(yǔ)。正文共分為五部分,主要內(nèi)容有: 第一部分:從基本理論入手,界定了資源節(jié)約型社會(huì)的內(nèi)涵,分析了資源節(jié)約型社會(huì)提出的背景。 第二部分:通過(guò)對(duì)山西資源利用現(xiàn)狀進(jìn)行分析,指出了其中存在的問(wèn)題,說(shuō)明了山西建設(shè)資源節(jié)約型社會(huì)的必要性和重大意義。 第三部分:主要對(duì)山西建設(shè)資源節(jié)約型社會(huì)的法律現(xiàn)狀進(jìn)行分析,指出了存在的問(wèn)題主要有:法律體系不完備;立法指導(dǎo)思想不科學(xué);環(huán)境監(jiān)管機(jī)制不暢;環(huán)保法律意識(shí)淡薄。 第四部分:介紹了國(guó)外建設(shè)資源節(jié)約型社會(huì)的法律方面的成功經(jīng)驗(yàn)和對(duì)山西的啟示。概括指出了美、日、德、瑞典等發(fā)達(dá)國(guó)家的成功做法:法律體系科學(xué)、完備;重視可持續(xù)發(fā)展原則;環(huán)境監(jiān)管機(jī)制高效以及重視環(huán)保宣傳教育。 第五部分:本部分為本文的核心內(nèi)容。針對(duì)山西建設(shè)資源節(jié)約型社會(huì)存在的法律問(wèn)題,在借鑒國(guó)外成功經(jīng)驗(yàn)的基礎(chǔ)上,提出了完善的法律建議。主要有:法律體系完備化;立法指導(dǎo)思想科學(xué)化;監(jiān)管機(jī)制高效化以及環(huán)保法制宣傳加強(qiáng)化。
[Abstract]:At present, our country is faced with severe environmental resource problem. Building a resource-conserving society is the inevitable choice to solve the problem of environmental resources and realize sustainable development. Shanxi Province is the largest energy and heavy chemical production base in China. However, with the rapid development of economy, extensive and high cost of economic development, the constraint contradiction of resources becomes more and more prominent. Therefore, it is imperative to build a resource-conserving society. To achieve this goal, it is necessary to have corresponding laws and regulations to support and ensure. Firstly, this paper carries on the current legal situation of the construction of resource-saving society in Shanxi Province. Analysing and pointing out the legal problems therein, Then it summarizes the successful experiences of foreign countries in the construction of resource-conserving society, and finally consummates the relevant legal problems of constructing resource-conserving society in Shanxi by using the successful experience of foreign countries for reference. This paper includes introduction, text and conclusion. The text is divided into five parts, the main content is:. The first part: starting with the basic theory, defines the connotation of the resource-saving society and analyzes the background of the resource-saving society. The second part: through the analysis of the present situation of resource utilization in Shanxi Province, this paper points out the existing problems, and explains the necessity and significance of constructing a resource-saving society in Shanxi Province. The third part: mainly analyzes the present situation of the construction of resource-saving society in Shanxi Province, and points out the existing problems: imperfect legal system, unscientific guiding ideology of legislation, poor mechanism of environmental supervision and control; The legal consciousness of environmental protection is weak. Part 4th: it introduces the successful experience of foreign countries in the legal aspects of constructing resource-saving society and its enlightenment to Shanxi, and points out the successful practices of developed countries such as the United States, Japan, Germany, Sweden and so on: scientific and complete legal system; Attach importance to the principle of sustainable development, the mechanism of environmental supervision, and the publicity and education of environmental protection. Part 5th: this part is divided into the core content of this paper. In view of the legal problems existing in the construction of resource-saving society in Shanxi Province, based on the successful experience of foreign countries, the author puts forward some perfect legal suggestions. The guiding ideology of legislation is scientific, the mechanism of supervision is highly efficient and the propaganda of environmental protection and legal system has been strengthened.
