【摘要】：交付在物權(quán)法上和合同法上的法律意義不同,在物權(quán)法中交付是物權(quán)變動的一種公示方式,指示交付、占有改定不應(yīng)規(guī)定為公示方式;而在合同法中的交付只是合同的履行行為,無論是現(xiàn)實(shí)交付還是觀念交付均無不妥�，F(xiàn)實(shí)交付在占有移轉(zhuǎn)時生效,觀念交付隨意思表示的生效而生效。物權(quán)法第23條中的"法律另有規(guī)定"的情形有4種,不包括合同法第133條"當(dāng)事人的約定"在內(nèi)。準(zhǔn)不動產(chǎn)物權(quán)變動有交付和登記兩種公示方式,占有與登記不一致時以登記為準(zhǔn),但登記權(quán)利人惡意的除外;其物權(quán)的設(shè)立和轉(zhuǎn)讓自交付時發(fā)生效力,其物權(quán)的變更、消滅,應(yīng)當(dāng)予以登記;登記權(quán)利人處分其物權(quán)的行為不適用善意取得制度。
[Abstract]:Delivery in real right law and contract law in the legal meaning is different, in the real right law delivery is a kind of real right change public way, instructs the delivery, the possession change should not be stipulated as the public display way; The delivery in contract law is only the performance of the contract, whether the actual delivery or the concept of delivery are not inappropriate. The actual delivery takes effect in the transfer of possession, and the concept delivery takes effect with the effect of the expression of intention. There are four kinds of cases in Article 23 of Real right Law, excluding Article 133 of contract Law, "Agreement of the parties". There are two modes of public display for the alteration of real right of quasi-immovable property: delivery and registration. Registration shall prevail in case of inconsistency between possession and registration, except in the case of malice on the part of the registered right holder; the establishment and transfer of the property right shall take effect from the time of delivery, and the change and elimination of the real right shall be effected. It should be registered and the bona fide acquisition system should not be applied to the registration of the right holder's disposition of his real right.
