【摘要】:隨著上海城市軌道交通"十字加環(huán)多放射線"狀線網(wǎng)運營模式的形成,運營組織方式亦呈現(xiàn)日趨復雜等特征,上海城市軌道交通迎來了網(wǎng)絡(luò)化運營管理時代。我國《合同法》對軌道交通運營管理企業(yè)采取了嚴格責任歸責原則。這無疑從客觀上加重了對運營管理企業(yè)的社會法律責任。通過對當前上海城市軌道交通網(wǎng)絡(luò)化運營管理適用法律的現(xiàn)狀分析,結(jié)合嚴格責任歸責原則對網(wǎng)絡(luò)化運營的挑戰(zhàn),提出了網(wǎng)絡(luò)化運營管理時代針對該歸責原則的一些建議和對策。
[Abstract]:With the formation of the "cross plus ring multi-ray" network operation mode of Shanghai urban rail transit, the operation organization mode is becoming more and more complex and so on. Shanghai urban rail transit has ushered in the era of network operation management. The contract Law of our country has adopted the strict liability imputation principle to the rail transit operation management enterprises. This undoubtedly intensifies the society of the operation and management enterprises objectively. Through the analysis of the current situation of the applicable laws of the network operation management of Shanghai urban rail transit, Combined with the challenge of strict liability imputation principle to network operation, this paper puts forward some suggestions and countermeasures in the era of network operation management.
