【摘要】：船舶國(guó)籍登記既是我國(guó)海事行政機(jī)關(guān)擔(dān)負(fù)的一項(xiàng)重要的海事行政管理職能,也是世界各國(guó)普遍采用的一種重要的船舶登記管理方式。目前,我國(guó)實(shí)行的是嚴(yán)格船舶登記制度,對(duì)船舶國(guó)籍登記的各項(xiàng)要求與相關(guān)監(jiān)管都很?chē)?yán)格,這雖有利于維護(hù)我國(guó)航運(yùn)市場(chǎng)的穩(wěn)定,但也導(dǎo)致了大量中資遠(yuǎn)洋輪出籍海外而嚴(yán)重削弱我國(guó)的國(guó)際航運(yùn)實(shí)力與國(guó)際航運(yùn)地位的問(wèn)題。曾經(jīng)面臨類(lèi)似問(wèn)題的挪威、丹麥等傳統(tǒng)海運(yùn)強(qiáng)國(guó)通過(guò)建立、實(shí)施兼具嚴(yán)格型與靈活性的國(guó)際船舶登記制度而有效解決了前述問(wèn)題。有鑒于此,我國(guó)已在天津東疆保稅港區(qū)建立起了國(guó)際船舶登記制度的創(chuàng)新試點(diǎn),準(zhǔn)備今后在全國(guó)范圍內(nèi)適時(shí)建立實(shí)施國(guó)際船舶登記法律制度,但相關(guān)研究還較為薄弱,國(guó)內(nèi)在此方面的立法也屬空白,為此本文從法律制度層面上對(duì)國(guó)際船舶登記制度進(jìn)行全面而系統(tǒng)的研究,以求探索出符合我國(guó)航運(yùn)發(fā)展實(shí)情與需要的國(guó)際船舶登記法律制度的基本立法與司法制度,從而為今后相關(guān)實(shí)踐提供必要的理論依據(jù)和參考。 論文包括引言、正文與結(jié)論三大部分。引言主要就論文的研究范疇與價(jià)值、相關(guān)研究狀況、研究方法以及本文要解決的問(wèn)題作簡(jiǎn)要介紹。正文按照從總到分、由外到內(nèi)、從宏觀到微觀的邏輯順序分為以下六章：第一章是對(duì)國(guó)際船舶登記制度的概述,通過(guò)厘清國(guó)際船舶登記制度的基本理論問(wèn)題為后文的深入剖析奠定必要的理論基礎(chǔ)；第二章是對(duì)國(guó)際船舶登記制度與相關(guān)船舶國(guó)籍登記制度進(jìn)行全面和系統(tǒng)的比較分析,由此揭示出該法律制度的優(yōu)勢(shì)與缺陷；第三章是對(duì)域外國(guó)際船舶登記制度進(jìn)行全面地比較分析,以此為我國(guó)今后建立、實(shí)施該法律制度提供重要的制度參考；第四章是從多個(gè)角度對(duì)我國(guó)建立、實(shí)施國(guó)際船舶登記制度的必要性進(jìn)行深入研究；第五章是從多方面來(lái)論證我國(guó)建立、實(shí)施國(guó)際船舶登記制度的可行性；第六章是結(jié)合我國(guó)海運(yùn)的發(fā)展情況與我國(guó)的法律環(huán)境,提出今后構(gòu)建我國(guó)國(guó)際船舶登記法律制度的相關(guān)立法與司法建議,重點(diǎn)對(duì)制定《中華人民共和國(guó)國(guó)際船舶登記管理規(guī)定》提出詳細(xì)的立法建議。最后,本論文的結(jié)論部分在對(duì)全文加以概括、整合的基礎(chǔ)上,系統(tǒng)歸納了本論文的主要觀點(diǎn)。
[Abstract]:Nationality registration of ships is not only an important function of maritime administration in our country, but also an important management method of ship registration adopted by countries all over the world. At present, China is implementing a strict ship registration system, and all requirements and relevant regulations for ship nationality registration are very strict, although this is conducive to maintaining the stability of the shipping market in our country. However, it also leads to a large number of overseas Chinese ocean-going vessels, which seriously weaken China's international shipping strength and international shipping status. The traditional shipping powers such as Norway and Denmark, which have faced similar problems, have solved these problems effectively by establishing and implementing a strict and flexible international ship registration system. In view of this, China has established an innovative pilot project of international ship registration system in Tianjin Dongjiang bonded Port area, and is prepared to establish and implement the international ship registration legal system in a timely manner throughout the country in the future, but the relevant research is still relatively weak. The domestic legislation in this respect is also blank. Therefore, this paper makes a comprehensive and systematic study on the international ship registration system from the legal system. In order to explore the basic legislation and judicial system of the international ship registration legal system, which is in line with the actual situation and needs of the shipping development in China, this paper provides the necessary theoretical basis and reference for the related practice in the future. The thesis includes three parts: introduction, text and conclusion. The introduction mainly introduces the research category and value, the related research situation, the research methods and the problems to be solved in this paper. The text is divided into the following six chapters according to the logic sequence from total to division, from outside to inside, from macro to micro: the first chapter is an overview of the international ship registration system. By clarifying the basic theoretical issues of the international ship registration system, this paper lays the necessary theoretical foundation for the further analysis. The second chapter is a comprehensive and systematic comparative analysis of the international ship registration system and the related ship nationality registration system, which reveals the advantages and disadvantages of the legal system. The third chapter is to carry on the comprehensive comparative analysis to the extraterritorial international ship registration system, so as to provide the important system reference for our country in the future to establish and implement the legal system; The fourth chapter is to study the necessity of establishing and implementing international ship registration system from many angles, the fifth chapter is to prove the feasibility of establishing and implementing international ship registration system in China from many aspects. The sixth chapter is based on the development of maritime transport in China and the legal environment of our country, and puts forward the relevant legislative and judicial suggestions for the construction of the legal system of international ship registration in China in the future. Detailed legislative suggestions are put forward for the formulation of the regulations of the people's Republic of China on the Administration of International ship Registration. Finally, the conclusion of this paper summarizes the main points of this paper on the basis of integration.
