【摘要】：隨著全球經(jīng)濟(jì)一體化的全面發(fā)展,國際投資已經(jīng)成為現(xiàn)代經(jīng)濟(jì)活動的一種重要形式,國際投資自由化的程度進(jìn)一步加強(qiáng)。但同時(shí)國際投資中的環(huán)境問題也日益突出,逐漸成為人類社會所面臨的巨大挑戰(zhàn)。國際投資中的環(huán)境問題己引起國際社會的普遍關(guān)注。本文立足于國際投資與環(huán)境關(guān)系問題,重點(diǎn)分析國際投資中的環(huán)境保護(hù)法律問題,并結(jié)合我國的實(shí)踐,提出完善我國投資法制中有關(guān)環(huán)境保護(hù)的相關(guān)建議。 本文第一部分主要從國際投資、國際投資自由化、環(huán)境問題全球化以及環(huán)境保護(hù)全球化的現(xiàn)狀和基本概況出發(fā),探討了國際投資目前的發(fā)展?fàn)顩r以及目前的全球環(huán)境問題。從二者的現(xiàn)有狀況出發(fā),分析國際投資與環(huán)境保護(hù)的關(guān)系為下文對國際投資與環(huán)境保護(hù)的研究進(jìn)行鋪墊。 第二部分主要研究各國已經(jīng)簽訂的大部分國際投資協(xié)定的有關(guān)環(huán)境保護(hù)條款。尤其是以北美自由貿(mào)易協(xié)定及我國近幾年簽訂的自由貿(mào)易協(xié)定為重點(diǎn),研究涉及到環(huán)境保護(hù)的投資協(xié)定中環(huán)境保護(hù)條款的概況、國際投資協(xié)定中環(huán)境保護(hù)條款的內(nèi)容以及環(huán)境保護(hù)條款在國際投資協(xié)定中的表現(xiàn)形式。 第三部分主要在第二部分的基礎(chǔ)上,對國際投資協(xié)定中有關(guān)環(huán)境保護(hù)條款的效力以及環(huán)境保護(hù)與投資的效力沖突進(jìn)行探析,分析環(huán)境保護(hù)條款在國際投資協(xié)定中的效力問題,探討環(huán)境保護(hù)與投資的沖突及其原因。 第四部分主要分析了目前國際投資與環(huán)境保護(hù)沖突的可協(xié)調(diào)性,以及目前我國國際投資法制中有關(guān)環(huán)境保護(hù)的現(xiàn)狀和我國的環(huán)境問題,并提出相應(yīng)的完善建議,以便我國在利用國際投資發(fā)展我國經(jīng)濟(jì)的同時(shí)更好的保護(hù)我國的環(huán)境,改善環(huán)境質(zhì)量狀況。
[Abstract]:With the overall development of global economic integration, international investment has become an important form of modern economic activities, and the degree of international investment liberalization has been further strengthened. But at the same time, the environmental problems in international investment have become increasingly prominent, gradually becoming a huge challenge to human society. The environmental problem in international investment has aroused the general concern of the international community. Based on the relationship between international investment and environment, this paper analyzes the legal problems of environmental protection in international investment, and puts forward some suggestions on how to perfect the legal system of investment in China. The first part of this paper mainly discusses the current development of international investment and the current global environmental problems from the current situation and basic situation of international investment, international investment liberalization, environmental globalization and environmental protection globalization. From the current situation of the two, the analysis of the relationship between international investment and environmental protection paves the way for the following research on international investment and environmental protection. The second part mainly studies the environmental protection provisions of most international investment agreements that countries have signed. In particular, focusing on the North American Free Trade Agreement (NAFTA) and the Free Trade Agreement (FTAs) signed by China in recent years, the general situation of environmental protection provisions in investment agreements involving environmental protection has been studied. The content of the environmental protection clause in the international investment agreement and its manifestation in the international investment agreement. The third part is mainly based on the second part, analyzes the effectiveness of the environmental protection clauses in the international investment agreements and the conflicts between the environmental protection and investment, and analyzes the effectiveness of the environmental protection clauses in the international investment agreements. This paper discusses the conflict between environmental protection and investment and its causes. The fourth part mainly analyzes the coordination of the conflict between international investment and environmental protection, the current situation of environmental protection in China's international investment legal system and the environmental problems of our country, and puts forward corresponding suggestions for improvement. In order to make use of the international investment to develop our economy, we can better protect our environment and improve the environmental quality at the same time.
