臨時勞動力流動全球性法律制度研究

【摘要】:近年來,不斷深化的經(jīng)濟全球化對國際勞動力流動的需求日益增長,同時也提供了更多便利的條件。其中臨時勞動力流動獲得了前所未有的發(fā)展速度,但是相比國際貿(mào)易和投資而言,其發(fā)展速度和規(guī)模仍非常有限。經(jīng)濟學(xué)家的分析表明,如果提高臨時勞動力流動自由化水平,將會給全球經(jīng)濟福利帶來巨大的提升。由于世界勞動力分布和發(fā)展不平衡,眾多發(fā)達國家出現(xiàn)越來越嚴重的人口老齡化問題,而不少發(fā)展中國家則在未來幾十年內(nèi)勞動力富足,這也給臨時勞動力流動的發(fā)展提供了契機。臨時勞動力流動要發(fā)展,需要相關(guān)法律制度,特別是全球性的多邊法律制度的保障和推動。本文以臨時勞動力流動全球性多邊法律制度為研究對象,確證其存在和發(fā)展的必要性,分析現(xiàn)行制度的現(xiàn)狀及不足,探尋未來發(fā)展的方向和路徑,提出我國應(yīng)對之策。 論文包括引言,本論和結(jié)論三部分,本論部分共計五章。 第一章臨時勞動力流動全球性法律制度的必要性及淵源。筆者首先對“臨時勞動力流動”這一概念進行了界定;然后在分析臨時勞動力流動法律制度的四種類型的基礎(chǔ)上,闡述了發(fā)展全球性多邊法律制度的必要性;接下來,文章梳理了臨時勞動力流動全球性制度的法律淵源。 第二章移徙工人公約對臨時性移徙工人的權(quán)利保障。移徙工人公約是臨時勞動力流動全球性法律制度的重要淵源。該章首先考察了臨時性移徙工人在就業(yè)國的待遇現(xiàn)狀,發(fā)現(xiàn)臨時性移徙工人的待遇不僅低于當?shù)毓と?甚至還低于永久性移徙工人。接下來,筆者從臨時性移徙工人權(quán)利保障的角度,對國際勞工組織和聯(lián)合國移徙工人公約進行了分別和綜合性的考察分析,得出移徙工人公約以權(quán)利保障為本位,賦予了移徙工人諸項權(quán)利,但是存在諸多不足和缺陷,特別是對臨時性移徙工人的權(quán)利保障重視不足。 第三章《服務(wù)貿(mào)易總協(xié)定》對臨時勞動力流動的規(guī)制。WTO《服務(wù)貿(mào)易總協(xié)定》是臨時勞動力流動全球性制度的另一大淵源。自然人存在是國際服務(wù)貿(mào)易的第四種方式,屬于臨時勞動力流動。自然人存在是一個非常模糊且狹小的概念,其范圍具有很大的不確定性。在自然人存在制度中,最惠國待遇是基石,具體承諾是核心,談判是制度完善的途徑。該章依次對自然人存在的定義和范圍、自然人存在最惠國待遇及例外、自然人存在具體承諾及自然人存在談判進行了分析研究,提出了應(yīng)拓展自然人存在主體的范圍,改善自然人存在具體承諾,推動自然人存在談判前行。 第四章臨時勞動力流動全球性法律制度的差異、協(xié)調(diào)與發(fā)展。WTO《服務(wù)貿(mào)易總協(xié)定》和移徙工人公約分屬于不同的制度體系,存在著較大的制度差異。鑒于現(xiàn)行的制度尚處于非常初級的發(fā)展階段,且存在明顯差異,因此需要在協(xié)調(diào)的基礎(chǔ)上謀求發(fā)展。該章首先分析了《服務(wù)貿(mào)易總協(xié)定》和移徙工人公約在臨時勞動力流動制度上存在的核心價值目標、術(shù)語、規(guī)范差異;然后圍繞著臨時勞動力流動全球性法律制度應(yīng)該如何發(fā)展這一問題,提出應(yīng)以發(fā)展為總價值目標,加強國際組織間的分工與合作,并列出三條可行的發(fā)展路徑。 第五章我國臨時勞動力流動法律制度的現(xiàn)狀及發(fā)展對策。該章從全球性法律制度、區(qū)域和雙邊法律制度、國內(nèi)法律制度三個層面分析了我國臨時勞動力流動法律制度的現(xiàn)狀。面對全球性法律制度的發(fā)展,針對我國相關(guān)法律制度發(fā)展的不足,筆者提出了五點對策建議,即積極參與WTO自然人存在談判、充分利用相關(guān)人權(quán)公約與勞工權(quán)利公約、參與并主導(dǎo)全球性多邊新規(guī)則的制定、發(fā)展區(qū)域和雙邊法律制度、完善國內(nèi)法律制度。
[Abstract]:In recent years , the deepening economic globalization has increased demand for international labor force , and provided more convenient conditions . The development speed and scale of the temporary labor force are still very limited compared with the international trade and investment . The analysis shows that , if the world labor force distribution and development are unbalanced , many developed countries have more and more serious population ageing .


The thesis consists of three parts : preface , theory and conclusion , and the part of this theory is five chapters .


The first chapter defines the necessity and origin of the global legal system of temporary labor force flow . Firstly , the author defines the concept of " temporary labor force " .
Then , on the basis of analyzing the four types of temporary labor flow legal system , this paper expounds the necessity of developing global multilateral legal system ;
Next , the article combs the legal origin of the global system of temporary labor flow .


Chapter II The protection of migrant workers ' rights to temporary migrant workers . The migrant workers convention is an important source of the global legal system of temporary migrant workers . The chapter first examines the status of temporary migrant workers ' treatment in the employment country , and finds that the treatment of temporary migrant workers is not only lower than that of local workers but also lower than permanent migrant workers .


Chapter 3 regulates the flow of temporary labor force . The WTO Agreement on Trade in Services Trade is another source of the global system of temporary labor force . The existence of natural person is the fourth mode of international service trade . The existence of natural person is a very vague and narrow concept , and its scope has great uncertainty . In the existence system of natural person , the most favored nation treatment is the core , and the negotiation is the perfect way of system .


Chapter IV The difference , coordination and development of the global legal system of temporary labor flow . The WTO Agreement on Trade in Services Trade and Migrant Workers ' Convention belong to different system systems . There is a great institutional difference . In view of the fact that the current system is still in a very early stage of development , there is a significant difference , it is necessary to seek development on the basis of coordination .
Then , about how the global legal system should be developed around the global legal system , this paper puts forward three feasible paths of development , which should aim at the development of the general value and strengthen the division and cooperation among international organizations .


Chapter five analyzes the present situation of the current legal system of temporary labor force in China , and analyzes the current situation of the current legal system of temporary labor force in China from three aspects of global legal system , regional and bilateral legal system and domestic legal system . In the face of the development of the global legal system , the author puts forward five countermeasures , namely , actively participated in WTO natural person negotiation , fully utilized relevant human rights conventions and labour rights conventions , participated in and led the formulation of global multilateral new rules , developed regional and bilateral legal system , and perfected the domestic legal system .
