【摘要】：海盜犯罪日益猖獗嚴(yán)重危及海上航行安全,海盜已經(jīng)成為人類的公敵,當(dāng)今海盜犯罪呈現(xiàn)紛繁復(fù)雜的形態(tài),海盜犯罪團(tuán)伙與恐怖主義組織進(jìn)行勾結(jié),防治海盜行為勢(shì)在必行。但是防治海盜行為的國(guó)際公約和參與的締約國(guó)數(shù)量均有限,國(guó)際公約缺乏完善的法律機(jī)制和有效的約束機(jī)制,各國(guó)關(guān)于海盜罪的國(guó)內(nèi)立法也是存在諸多不足,種種因素使部分國(guó)家在防治海盜行為面前顯得束手無(wú)策,因此加強(qiáng)國(guó)家間的合作防治海盜行為是不可阻擋的趨勢(shì)。海盜問(wèn)題對(duì)中國(guó)的危害也是不容忽視的,危及海上絲綢之路的安全,因此我國(guó)也在積極采取各項(xiàng)措施防治海盜行為維護(hù)海上航行安全。本文共分為四個(gè)部分,第一部分主要介紹海盜行為的基本問(wèn)題,第二部分主要介紹制止海盜行為維護(hù)海洋航行安全的法律制度,包括國(guó)際法律制度和各國(guó)國(guó)內(nèi)法律制度,第三部分主要介紹完善防治海盜行為國(guó)際合作法律機(jī)制,分析國(guó)際合作制止海盜行為的必要性和可行性,國(guó)際合作防治海盜行為法律機(jī)制的兩種類型,指出面臨的問(wèn)題及完善的措施,第四部分主要介紹海盜行為對(duì)我國(guó)產(chǎn)生的影響、我國(guó)如何參與國(guó)際合作防治海盜行為、完善我國(guó)防治海盜行為的法律對(duì)策。
[Abstract]:Piracy crime is increasingly rampant and endangers the safety of maritime navigation. Piracy has become the public enemy of mankind. Nowadays, piracy crime presents a complex and complicated form, and pirate criminal groups collude with terrorist organizations. The prevention of piracy is imperative. However, the number of international conventions and States parties to the fight against piracy is limited, and international conventions lack sound legal mechanisms and effective binding mechanisms, There are also many deficiencies in the domestic legislation of various countries on the crime of piracy. Various factors make some countries seem helpless in preventing piracy. Therefore, it is an irresistible trend to strengthen cooperation among countries to prevent piracy. The problem of piracy can not be ignored and endangers the safety of the maritime Silk Road. Therefore, China is also actively taking various measures to prevent piracy and maintain the safety of maritime navigation. This paper is divided into four parts. The first part mainly introduces the basic problems of piracy. The second part mainly introduces the legal system of the suppression of piracy to maintain the safety of maritime navigation, including the international legal system and the domestic legal system of each country. The third part mainly introduces the improvement of the legal mechanism of international cooperation in the prevention and control of piracy. This paper analyzes the necessity and feasibility of international cooperation in the suppression of piracy, two types of legal mechanisms for international cooperation in the prevention of piracy, points out the problems faced and the measures to be taken to perfect them. Part 4th mainly introduces the impact of piracy on our country. How to participate in international cooperation to prevent piracy and perfect our country's legal countermeasures.
