【摘要】：人類對外層空間的探索從未停歇,前蘇聯首顆人造衛(wèi)星的成功發(fā)射標志了人類真正意義上揭開了探索外層空間的序幕。與其他領域不同的是,外層空間從人類第一次涉足與此就與軍事目的密不可分。并且有高速發(fā)展的空間科技作保障,外層空間軍事活動的種類也日新月異,外層空間的軍事化氣息逐漸增強。如何從立法層面對外層空間軍事化這一現象加以規(guī)制,成為了國際社會所面臨的重要問題。本文通過對近些年來對外層空間的國際、國內立法進行了梳理和分析,盡可能全面的對外層空間軍事立法領域的發(fā)展和變化進行論述。對外層空間軍事化立法領域存在的問題和缺失進行總結和研究,并總結出外層空間軍事化立法領域的特點。在此研究基礎上,結合國內外立法實際情況進一步探討如何更好的完善外層空間軍事化立法體系。本文提出了對外層空間軍事活動區(qū)分對待的觀點,以及立法進程要與空間科技發(fā)展同步。并通過加強外層空間軍事化立法機構的職能以及引入相關機制等手段來完善外層空間軍事化立法體系。
[Abstract]:Mankind's exploration of outer space has never stopped, and the successful launch of the first man-made satellite of the former Soviet Union marked the beginning of the exploration of outer space in the true sense of mankind. Outer space has been inextricably linked to military purposes since the first foray into outer space by mankind. It is also supported by rapidly developing space science and technology, and the types of military activities in outer space are changing rapidly. The militarization of outer space has gradually increased. How to regulate the phenomenon of outer space militarization from the legislative level has become an important problem facing the international community. Domestic legislation has been combed and analyzed, and the development and changes in the field of military legislation in outer space have been discussed as comprehensively as possible. The problems and deficiencies in the field of legislation on the militarization of outer space have been summarized and studied. And summed up the characteristics of the field of outer space militarization legislation. This paper discusses how to perfect the militarization of outer space legislation system according to the actual situation of domestic and foreign legislation. This paper puts forward the viewpoint that the military activities in outer space should be treated differently. The legislative process should be synchronized with the development of space science and technology, and the legislative system of outer space militarization should be improved by strengthening the functions of the outer space militarization legislative organs and introducing relevant mechanisms.
