公海保護區(qū)與“區(qū)域”法律制度沖突與協(xié)調(diào)問題研究

【摘要】:公海保護區(qū)作為國家管轄范圍之外海洋生物多樣性養(yǎng)護的有效措施,近年來得到廣泛的關(guān)注與發(fā)展。目前已經(jīng)有多個公海保護區(qū)的區(qū)域性實踐,在制度建設(shè)和管理實踐方面取得了不小的進展。但是現(xiàn)有公海保護區(qū)制度也存在許多問題,導致其接受范圍受到限制。公海保護區(qū)廣泛建立以后,勢必會對各國利用國際海底區(qū)域(以下簡稱"區(qū)域")的海洋資源產(chǎn)生影響和限制。本文旨在對這兩種法律機制的沖突表現(xiàn)和沖突原因進行深入分析,以探尋解決應(yīng)對之道,促進公海保護區(qū)制度的發(fā)展,提高公海保護區(qū)的接受范圍。本文從法律沖突和法律對策的角度,通過查閱中英文文獻資料,利用比較分析、歸納分析等研究方法,對兩個制度之間的沖突之處進行剖析,探究沖突產(chǎn)生的深層次原因,以尋求解決協(xié)調(diào)方法。本文共分成五個部分,第一部分對公海保護區(qū)和"區(qū)域"法律制度進行介紹,包括公海保護區(qū)的范圍和實踐,以及"區(qū)域"礦產(chǎn)資源開發(fā)制度及環(huán)境保護制度。第二部分對兩個法律制度之間的沖突進行分析,包括"區(qū)域"礦產(chǎn)資源活動導致的環(huán)境污染管轄權(quán)沖突、"區(qū)域"基因資源活動管轄權(quán)沖突等四個內(nèi)容。對沖突表現(xiàn)分析之后,第三部分開始探索沖突產(chǎn)生的法律原因,并在第四部分提出解決方案,包括建立全球性公海保護區(qū)法律制度,加強管理機關(guān)信息交流與合作等內(nèi)容。最后,在第五部分分析沖突對我國的影響以及應(yīng)對策略,為我國在海洋資源可持續(xù)利用方面提供建議,維護我國的海洋權(quán)益。
[Abstract]:As an effective measure for the conservation of marine biodiversity beyond areas of national jurisdiction, high seas protected areas have received extensive attention and development in recent years. Considerable progress has been made in institutional construction and management practices. However, there are also many problems in the existing high seas protected area system, resulting in restrictions on the scope of its acceptance. After the widespread establishment of the high seas protected areas, It is bound to have an impact on and limit the use by States of the marine resources of the international seabed area (hereinafter referred to as "the area"). The purpose of this paper is to conduct an in-depth analysis of the manifestations and causes of conflict between the two legal mechanisms in order to find solutions to the problem, To promote the development of the high seas protected area system and to increase the acceptance scope of the high seas protected area. From the angle of conflict of laws and legal countermeasures, this paper makes use of comparative analysis, inductive analysis and other research methods, through consulting Chinese and English literature, and making use of comparative analysis, inductive analysis, etc. This article is divided into five parts: the first part introduces the legal regime of the high seas protected area and the area. Including the scope and practice of protected areas on the high seas, as well as the regime for the exploitation of mineral resources in the area and the regime for the protection of the environment. Part two analyses the conflicts between the two legal regimes, It includes four parts: jurisdiction conflict of environmental pollution caused by mineral resources activities in the area and jurisdiction conflict of genetic resources activities in the area. After analyzing the conflict performance, the third part begins to explore the legal causes of the conflict. In part 4th, the author puts forward some solutions, including the establishment of a global legal system on high seas protected areas, and the strengthening of information exchange and cooperation among regulatory authorities. Finally, in part 5th, it analyzes the impact of the conflict on our country and its countermeasures. To provide suggestions for the sustainable use of marine resources in China, and to safeguard the marine rights and interests of our country.
