【摘要】：本文以歐盟新能源法律與政策為研究對象，對歐盟新能源法律與政策的構成、目標、原則以及內(nèi)容進行了較為系統(tǒng)地分析。在對歐盟新能源法律政策體系總體進行研究的基礎上，根據(jù)歐盟對能源次級立法的劃分，從四個方面分別探討了歐盟的可再生能源法律政策、核能法律政策、節(jié)能與能效法律政策以及新能源參與能源市場競爭的有關法律政策，并分析有關立法的特點與不足，評析歐盟的最新立法和提案。通過深入研究歐盟的新能源法律與政策體系，分析中國新能源法律與政策的不足，借鑒歐盟新能源法律與政策的成功經(jīng)驗，提出了改進中國有關法律政策的建議。 歐盟采用法律與政策相結合的方式促進和規(guī)范新能源的發(fā)展，一方面發(fā)揮法律所特有的調(diào)節(jié)、控制、管理、懲罰、引導等功能，另一方面利用政策更為靈活、多樣的特點，有效引導新能源領域各類主體的行為。 歐盟可再生能源法律政策已具有較完整的體系，既有表明政策導向的能源戰(zhàn)略作為指導，又分別在可再生能源發(fā)電、供熱制冷、運輸方面形成了具體的立法框架，同時對風能、生物燃料等能源類型也進行了專門的立法規(guī)范。另外，在歐盟和成員國層面上有效選擇和組合財政政策工具，在可再生能源的資助政策方面有了長足發(fā)展。 《建立歐洲原子能共同體條約》締造了歐盟成員國和平利用核能的合作框架，它在一個集中的監(jiān)控系統(tǒng)下保證了歐盟核能的供應安全。歐盟圍繞《建立歐洲原子能共同體條約》的重點行動領域發(fā)展核能的次級立法和政策，主要集中在核能共同企業(yè)、核能研發(fā)和知識傳播、核安全、原料供應、核原料安全管制等方面。歐盟一直重視核安全立法，尤其是近幾年在核設施安全、放射性廢物和核廢料安全、輻射防護基本安全方面都采取了最新的立法措施。歐盟在2011年3月福島第一核電站事故后，加快推進核安全方面法律和政策的制定進程，確保歐盟核能在保證安全的基礎上正常發(fā)展。 提高能源效率可以替代增加能源供給，因此能源效率在很多方面被看做歐洲最大的能源資源。歐盟節(jié)能與能源效率法律政策覆蓋范圍廣，涉及終端使用能效、建筑物能源表現(xiàn)、用能產(chǎn)品標簽、熱電聯(lián)產(chǎn)和用能產(chǎn)品的生態(tài)設計五大方面，次級立法以指令和條例為主。歐盟節(jié)能與能源效率的政策工具較多，，包括與工業(yè)的自愿協(xié)議，向消費者提供信息，委員會支持項目等。在資助政策方面，歐盟主要使用公共基金、市場基礎上的工具以及私人支持基金三類工具，分別形成了各具特點的資助項目。2011年歐盟提出新的能源效率立法提案，體現(xiàn)了對分散在各領域的節(jié)能與能源效率法律政策進行整合的趨勢，并要采取有法律約束力的行動，促使成員國在節(jié)能和能源效率方面執(zhí)行更為有效的措施。 歐盟法律政策體系的制度設計在歐盟內(nèi)部能源市場一體化中起到了重要作用，它既是歐盟應對能源安全方面挑戰(zhàn)的重要工具，也是促進新能源發(fā)展的主要措施，更是實現(xiàn)歐盟可持續(xù)發(fā)展目標必不可少的條件。從第一次能源改革方案到第三次能源改革方案，歐盟內(nèi)部能源市場自由競爭已經(jīng)深入到市場的各個環(huán)節(jié)，并把電力、天然氣、可再生能源、核能等部門都融入到統(tǒng)一的內(nèi)部能源市場中，有利于新能源進入能源網(wǎng)絡，參與市場競爭。這種競爭需求也為歐盟節(jié)能和能源效率技術的發(fā)展提供了契機，促使歐盟通過一系列節(jié)能和能效計劃來提高其內(nèi)部能源市場的整體能源效率。 經(jīng)過幾十年的發(fā)展，歐盟新能源法律政策已經(jīng)具有前瞻性、全面性、協(xié)調(diào)性等顯著特點。新能源在未來仍將是歐盟法律政策發(fā)展的重要領域。歐盟新能源法律政策呈現(xiàn)出五大發(fā)展趨勢：歐盟將通過發(fā)展新能源法律政策推動經(jīng)濟復蘇；能源效率是未來新能源法律政策的中心；歐盟將進一步完善內(nèi)部能源市場，確保新能源在內(nèi)部市場自由流動；新能源將是歐盟技術創(chuàng)新的重點領域；歐盟將發(fā)展新能源國際合作的全面戰(zhàn)略。 隨著中國經(jīng)濟的較快發(fā)展和工業(yè)化、城鎮(zhèn)化進程的加快，能源需求不斷增長，構建穩(wěn)定、經(jīng)濟、清潔、安全的能源供應體系面臨著重大挑戰(zhàn)。中國新能源的發(fā)展需要完善能源法律制度，為增加能源供應、規(guī)范能源市場、優(yōu)化能源結構、維護能源安全提供法律保障。歐盟在可再生能源、核能、節(jié)能與能源效率以及市場競爭等新能源法律政策方面的豐富經(jīng)驗，對中國的新能源法律政策建設具有借鑒意義。中國可以從重視承擔有區(qū)別的責任、加強立法研究、探索新能源法律政策體系、增強新能源法律政策執(zhí)行力、協(xié)調(diào)運用政策工具以及加強國際合作等方面入手，逐步完善新能源立法和政策制定，為實現(xiàn)我國的能源安全和可持續(xù)發(fā)展提供良好的法律和政策基礎。
[Abstract]:On the basis of the study of EU ' s new energy law and policy , the paper probes into the EU ' s new energy law policy , nuclear energy legal policy , energy saving and energy efficiency legal policy and new energy participation in the energy market competition . The EU adopts the combination of laws and policies to promote and regulate the development of new energy , and plays a role in regulating , controlling , managing , punishing , guiding and so on . On the other hand , it can effectively guide the behavior of all kinds of subjects in the new energy field by means of more flexible and varied policies . The EU renewable energy law policy has a relatively complete system , which not only indicates the policy - oriented energy strategy as a guide , but also forms a specific legislative framework for the energy types such as renewable energy power generation , heat supply refrigeration and transportation , and also carries out special legislative norms for the energy types such as wind energy and biofuels . The European Union attaches great importance to the development of nuclear safety legislation , especially in recent years in the aspects of nuclear safety , nuclear energy research and development and knowledge dissemination , nuclear safety , raw material supply , nuclear material safety control , etc . EU energy - saving and energy efficiency law policy covers a broad range of energy efficiency , building energy performance , energy product labelling , cogeneration and energy products . The EU proposes new legislation on energy efficiency , which embodies the trend of integration of energy - saving and energy efficiency legal policies in all fields , and takes a legally binding action to encourage member countries to implement more effective measures in terms of energy conservation and energy efficiency . The system design of EU ' s legal policy system plays an important role in the EU ' s internal energy market integration . It is an important tool for the EU to meet the challenges of energy security , and it is necessary to promote the sustainable development goals of the European Union . After decades of development , the EU ' s new energy law policy has been characterized by forward - looking , comprehensive , coordinated and so on . New energy will continue to be an important area of EU ' s legal policy development in the future . The EU will promote economic recovery through the development of new energy laws and policies . The EU will further improve the internal energy market and ensure the free flow of new energy in the internal market ; the new energy will be the focus area of EU technological innovation ; and the EU will develop a comprehensive strategy for new energy international cooperation . With the rapid development and industrialization of China ' s economy , the acceleration of the urbanization process , the increasing demand of energy , the construction of stable , economical , clean and safe energy supply system is facing a great challenge .
