刑事庭審中法官話語(yǔ)立足點(diǎn)轉(zhuǎn)換的多模態(tài)研究(英文)

本文基于話語(yǔ)立足點(diǎn)的概念,以多模態(tài)話語(yǔ)分析為框架,以一次刑事上訴審的法官話語(yǔ)為例,探討刑事庭審中法官話語(yǔ)與其立足點(diǎn)轉(zhuǎn)換間的關(guān)系。研究發(fā)現(xiàn),庭審互動(dòng)中法官話語(yǔ)的多模態(tài)資源包括會(huì)話特征(拖音、打斷、重復(fù)、話輪轉(zhuǎn)換等)、聲學(xué)特征(音高的基頻值提高、音強(qiáng)的分貝值增加、輔音與元音間過渡音征、重點(diǎn)語(yǔ)句中關(guān)鍵詞音長(zhǎng)等)、視覺特征(面向法庭當(dāng)事人、面朝文字資料、面向法庭等),法官調(diào)用的多模態(tài)資源激活其不同的立足點(diǎn),包括"話語(yǔ)激活者"、"話語(yǔ)激活者+話語(yǔ)作者"、"話語(yǔ)激活者+話語(yǔ)作者+話語(yǔ)委托者"等,模態(tài)資源的綜合作用引發(fā)話語(yǔ)立足點(diǎn)的改變。研究結(jié)果同時(shí)體現(xiàn)了法官立足點(diǎn)轉(zhuǎn)換承載的庭審組織、信息確認(rèn)、事實(shí)調(diào)查、合議庭代言和法庭普法等功能。
