【摘要】：檢察官職業(yè)保障制度是司法制度的重要組成部分，也是當(dāng)前檢察官制度研究中的一個(gè)基本課題。檢察官作為檢察權(quán)行使的主體，為保證其不致因獨(dú)立、公正行使職權(quán)而受人身、財(cái)產(chǎn)乃至社會(huì)地位等方面的貶損,維護(hù)法律監(jiān)督的有效性與公正性，必須為檢察官提供充分、全面的職業(yè)保障。建立和完善與檢察職業(yè)特點(diǎn)相適應(yīng)的職業(yè)保障制度，，不僅體現(xiàn)了檢察官群體的合法利益，更是實(shí)現(xiàn)司法公正、體現(xiàn)司法權(quán)威的需要。本文主要采取理論探究、實(shí)證分析和比較研究的方法，從法律、理論和實(shí)踐等方面，對(duì)我國(guó)檢察官職業(yè)保障制度運(yùn)行現(xiàn)狀、存在問題及制約因素進(jìn)行系統(tǒng)分析，在對(duì)國(guó)外檢察官職業(yè)保障制度進(jìn)行比較分析，并借鑒有益經(jīng)驗(yàn)基礎(chǔ)上，提出了改革和完善我國(guó)檢察官職業(yè)保障制度的有效路徑。 全文除引言和結(jié)語(yǔ)外，正文由四個(gè)部分組成。第一部分是對(duì)檢察官職業(yè)保障制度的概述。主要闡述了檢察官職業(yè)保障制度的基本內(nèi)涵、性質(zhì)地位及重要意義。第二部分論述對(duì)我國(guó)檢察官職業(yè)保障的現(xiàn)實(shí)考察，從職權(quán)保障、身份保障、社會(huì)保障等方面分析我國(guó)檢察官職業(yè)保障制度運(yùn)行現(xiàn)狀并進(jìn)行評(píng)價(jià)，討論該制度存在的問題，進(jìn)而探尋問題背后的深層原因（包括社會(huì)觀念、體制環(huán)境、檢察官專業(yè)化職業(yè)化、法律制度及檢察研究等）。第三部分論述國(guó)外檢察官職業(yè)保障制度的啟示與借鑒。主要介紹了英美法系、大陸法系的代表國(guó)家有關(guān)檢察官職權(quán)保障、身份保障、社會(huì)保障、榮譽(yù)保障等方面的制度概況，以便為我國(guó)檢察官職業(yè)保障制度的改革完善提供借鑒。第四部分提出并論述了改革完善我國(guó)檢察官職業(yè)保障制度的應(yīng)然目標(biāo)、基本原則，并提出了改革完善檢察官職業(yè)保障制度的具體制度機(jī)制以及完善外部管理機(jī)制、內(nèi)部運(yùn)行機(jī)制等其他配套機(jī)制的思路。
[Abstract]:The public procurator occupational security system is an important part of the judicial system, and is also a basic subject in the current research of the procurator system. As the subject of the exercise of procuratorial power, in order to ensure that the procurator does not suffer derogation from personal, property and even social status due to independence and impartiality, it is necessary to provide the public prosecutor with sufficient resources to maintain the effectiveness and impartiality of legal supervision. Comprehensive job security. The establishment and perfection of the occupational security system adapted to the characteristics of the procuratorial profession not only reflects the legitimate interests of the public procurators, but also realizes judicial justice and reflects the needs of judicial authority. This paper mainly adopts the methods of theoretical research, empirical analysis and comparative study, and systematically analyzes the current situation, existing problems and restrictive factors of the public procurator occupational security system in China from the aspects of law, theory and practice. Based on the comparative analysis of the professional security system of public procurators abroad and on the basis of useful experience, this paper puts forward an effective way to reform and perfect the professional security system of public procurators in China. In addition to the introduction and conclusion, the text consists of four parts. The first part is an overview of the occupational security system for prosecutors. This paper mainly expounds the basic connotation, nature and significance of the public procurator's job security system. The second part discusses the reality of our country's procurator occupational security, analyzes and evaluates the current situation of our country's procurator occupational security system from the aspects of authority, identity and social security, and discusses the existing problems of this system. Then it explores the underlying causes of the problem (including social concepts, institutional environment, professionalization of prosecutors, legal system and procuratorial research, etc.). The third part discusses the inspiration and reference of foreign public procurator occupational security system. This paper mainly introduces the general situation of the public procurator's functions and powers, identity, social security, honor guarantee and so on in the representative countries of Anglo-American law system and civil law system, in order to provide reference for the reform and perfection of our country's procurator's occupational security system. The fourth part puts forward and discusses the necessary goals and basic principles of reforming and perfecting the procurator's occupational security system in our country, and puts forward the concrete system mechanism of reforming and perfecting the procurator's occupational security system as well as the external management mechanism.
