【摘要】：農(nóng)村土地流轉(zhuǎn)是新時期促進農(nóng)村經(jīng)濟改革的重要抓手,是盤活農(nóng)村經(jīng)濟,加快農(nóng)業(yè)產(chǎn)業(yè)結(jié)構(gòu)調(diào)整的重要方式,更是發(fā)展農(nóng)民權益的重要安排。由于流轉(zhuǎn)中制度不完善、操作不規(guī)范等因素的影響,土地流轉(zhuǎn)糾紛頻發(fā),損害農(nóng)民土地利益也影響農(nóng)村經(jīng)濟社會長足發(fā)展,是迫切需要解決的問題。在當前我國城鄉(xiāng)統(tǒng)籌和新農(nóng)村建設的背景下,農(nóng)村土地流轉(zhuǎn)糾紛的產(chǎn)生一方面反映了農(nóng)村土地流轉(zhuǎn)中不規(guī)范因素的存在,另一方面也反映了新時期農(nóng)民土地利益訴求的空前高漲,這也使得農(nóng)村土地流轉(zhuǎn)糾紛表現(xiàn)出異于其他糾紛的政策色彩。同時,土地流轉(zhuǎn)糾紛的解決涉及到土地利益分配和土地資源長足發(fā)展,農(nóng)民與農(nóng)村發(fā)展的重大問題,如何協(xié)調(diào)個中關系尤為重要。結(jié)合當前農(nóng)村社區(qū)發(fā)展的經(jīng)驗和啟示,本研究以社區(qū)發(fā)展為視角,堅持理論研究與實證分析相結(jié)合,著力探索實現(xiàn)農(nóng)村土地流轉(zhuǎn)糾紛和諧解決之路徑。 在研究中,筆者首先從基本范疇確定入手,明確農(nóng)村土地流轉(zhuǎn)糾紛解決機制的相關概念,確定研究對象；同時進一步明確農(nóng)村社區(qū)發(fā)展與農(nóng)村土地流轉(zhuǎn)糾紛解決機制之間的互促互利關系；并從生存權與發(fā)展權、社區(qū)發(fā)展權、利益與利益機制、權利救濟和社會控制等理論出發(fā)對農(nóng)村土地流轉(zhuǎn)糾紛解決機制進行不同層面的闡述,奠定后文研究的理論基礎。 其次,通過實證分析把握新時期農(nóng)村土地流轉(zhuǎn)糾紛多樣性、易激化等特點,結(jié)合農(nóng)村土地流轉(zhuǎn)糾紛產(chǎn)生的政策、法律、管理服務等因素,從糾紛解決的機構(gòu)設置、制度安排、解紛依據(jù)以及解紛效果等方面的不足入手分析當前農(nóng)村土地流轉(zhuǎn)糾紛解決機制的困境。通過考察英、法、德、日等國在土地流轉(zhuǎn)及相關糾紛解決的實踐,為我國農(nóng)村土地流轉(zhuǎn)糾紛解決機制的完善凝練可資借鑒的經(jīng)驗。 最后,結(jié)合我國國情,以農(nóng)民權益保護、農(nóng)村土地資源優(yōu)化配置、農(nóng)村社區(qū)和諧發(fā)展為基本理念,遵循從制度和諧到利益和諧、從糾紛解決到綜合治理、從多元協(xié)作到以社區(qū)為中心的基本思路,從主體多元互動、制度多元銜接、規(guī)則多元協(xié)調(diào),以及配套機制的完善與健全等方面著手,構(gòu)建集糾紛預防與解決于一體的綜合性農(nóng)村土地流轉(zhuǎn)糾紛解決機制。提出將農(nóng)村社區(qū)和社區(qū)調(diào)解組織作為土地流轉(zhuǎn)糾紛解決中各主體、環(huán)節(jié)連接的基本載體,通過社區(qū)參與和監(jiān)督實現(xiàn)糾紛解決中三元理念的實現(xiàn)；建立以社區(qū)調(diào)解為中心聯(lián)動調(diào)解機制,以土地仲裁為主的建立農(nóng)業(yè)仲裁制度,通過其他制度的配套實施,全面提高農(nóng)村糾紛基層化解的能力。
[Abstract]:The circulation of rural land is an important way to promote the reform of rural economy in the new period. It is also an important way to activate rural economy and speed up the adjustment of agricultural industrial structure. It is also an important arrangement for the development of farmers' rights and interests. Due to the influence of imperfect system and non-standard operation in the circulation, the frequent disputes over land circulation and the damage to farmers' land interests also affect the rapid development of rural economy and society, which is an urgent problem to be solved. Under the background of urban and rural planning and new rural construction, the emergence of disputes over rural land transfer reflects the existence of non-standard factors in rural land transfer. On the other hand, it also reflects the unprecedented upsurge of farmers' land interests in the new period, which makes the rural land transfer disputes show different policy color than other disputes. At the same time, the settlement of land transfer disputes involves the distribution of land interests and the rapid development of land resources. Combined with the current experience and inspiration of rural community development, this study takes community development as a perspective, insists on combining theoretical research with empirical analysis, and tries to explore the way to achieve a harmonious settlement of disputes over land circulation in rural areas. In the study, the author first from the basic category to determine, clear the rural land transfer dispute resolution mechanism related concepts, determine the object of study; At the same time, the relationship between rural community development and rural land transfer dispute resolution mechanism is further clarified. And from the survival and development rights, community development rights, interests and interest mechanism, rights relief and social control theory to rural land transfer dispute settlement mechanism of different levels, to lay the theoretical foundation for later studies. Secondly, through the empirical analysis to grasp the characteristics of rural land transfer disputes in the new period, such as diversity and aggravation, combined with the policy, law, management services and other factors of rural land transfer disputes, from the dispute resolution of the institutional setting, institutional arrangements, This paper analyzes the dilemma of the current dispute resolution mechanism of rural land circulation based on the basis of dispute resolution and the deficiency of dispute resolution effect. By investigating the practice of land circulation and related dispute resolution in Britain, France, Germany, Japan and other countries, this paper provides some useful experience for perfecting the dispute resolution mechanism of rural land circulation in China. Finally, considering the situation of our country, taking the protection of farmers' rights and interests, the optimal allocation of rural land resources and the harmonious development of rural communities as the basic concepts, following the principles of system harmony to benefit harmony, from dispute resolution to comprehensive management, From multiple cooperation to community as the center of the basic thinking, from the main body multiple interaction, system multiple convergence, rules and coordination, as well as the perfection and perfection of supporting mechanism, etc. To build a comprehensive dispute settlement mechanism of rural land circulation which integrates dispute prevention and settlement. The paper puts forward that the rural community and the mediation organization of the community should be regarded as the basic carrier of the connection between the main body and the link in the dispute resolution of land circulation, and realize the realization of the ternary concept in the dispute resolution through the participation and supervision of the community. Setting up the interlinked mediation mechanism with community mediation as the center, setting up the agricultural arbitration system with the land arbitration as the main body, and improving the ability of resolving the rural disputes at the grass-roots level through the supporting implementation of other systems.
