論輿論監(jiān)督與司法獨立的沖突與應(yīng)對

【摘要】:現(xiàn)代社會,經(jīng)濟和科技文化的發(fā)展促進了傳媒滲透社會領(lǐng)域的能力,也提升了新聞輿論對社會的影響力度。新聞媒體介入司法,對案件審理過程和裁判結(jié)果的關(guān)注,是我國法制觀念深入人心,法治建設(shè)不斷完善的重要表現(xiàn)。傳媒的介入,揭開了司法的神秘面紗,滿足了社會公眾的知情權(quán)和提高了社會的參與意識。然而,法院經(jīng)過正當(dāng)程序和有著合理證據(jù)的裁判有時會與公眾所理解的社會評價產(chǎn)生沖突。 由于媒體本身隱含的缺陷,如搶先、情感化等特性影響了報道的公正、理性的要求。現(xiàn)實中,媒體更關(guān)注糾紛中的受害者立場,并報以同情和輿論的支持,常常呼吁嚴懲罪犯,而司法追求的是司法的公正價值。在法律面前,雙方的地位是平等的,應(yīng)當(dāng)以正當(dāng)程序、合法證據(jù)這些去審理案件,從而實現(xiàn)法律價值所追求的正義公平。當(dāng)媒體過分報道具有偏向性的報道時,作為社會中的一部分,法官不可避免地被這些信息影響。因此如何立足我國國情,正確處理獨立審判與輿論監(jiān)督的關(guān)系,建立平衡獨立審判與輿論監(jiān)督?jīng)_突的機制成為現(xiàn)在法治進展中亟待解決的亟待解決的課題之一。本文運用比較分析、例證等方法,通過四個章節(jié)分析輿論監(jiān)督與司法獨立的關(guān)系,試圖為我國輿論監(jiān)督與司法關(guān)系的處理上提出具體建議。 第一章主要是介紹了輿論監(jiān)督與司法獨立的相關(guān)概念以及基本法理基礎(chǔ),使得讀者對于相關(guān)概念有所認識。然后通過介紹國內(nèi)近年來輿論對司法獨立的侵蝕,,并揭示司法機關(guān)對媒體的排斥系統(tǒng)闡述兩者之間的沖突。 第二章主要是對于輿論監(jiān)督與司法獨立兩者沖突的原因進行具體分析,主要是從根源的基本原因分析以及我國具體實踐中存在的偏差兩大層次進行剖析。 第三章主要是介紹域外法治國家處理輿論監(jiān)督與司法獨立沖突的相關(guān)實踐與立法的介紹,總結(jié)和分析它們實踐經(jīng)驗,為我國的建設(shè)提供借鑒思路 第四章主要針對我國具體情況,從法理基礎(chǔ)、基本原則、具體措施三個方面對我國現(xiàn)存的輿論監(jiān)督司法的問題提出具體建議。
[Abstract]:The development of modern society, economy, science and technology culture has promoted the media's ability to infiltrate the social field, and also enhanced the influence of the news and public opinion on the society. The news media intervene in the judicature and pay close attention to the trial process of cases and the result of adjudication, which is an important manifestation of our country's legal system concept being deeply rooted in the hearts of the people and the building of the rule of law constantly improving. The intervention of the media uncovers the mystery of judicature, satisfies the public's right to know and raises the consciousness of social participation. However, due process and reasoned decisions of courts sometimes conflict with social evaluation as understood by the public. Because of the inherent defects of the media, such as preemptive, emotional and other characteristics affect the fair and rational requirements of the report. In reality, the media pay more attention to the position of victims in disputes, and often call for severe punishment of criminals with sympathy and support from public opinion, while the judicial pursuit is the value of justice. Before the law, the status of both sides is equal, should be due process, legal evidence to try cases, so as to achieve the legal value of the pursuit of justice and fairness. As a part of society, judges are inevitably influenced by this information when the media over-reports biased reports. Therefore, how to correctly deal with the relationship between independent trial and public opinion supervision, and how to establish a mechanism to balance the conflict between independent trial and public opinion supervision has become one of the urgent issues in the progress of the rule of law. By means of comparative analysis and examples, this paper analyzes the relationship between public opinion supervision and judicial independence through four chapters, and tries to put forward some concrete suggestions for the handling of the relationship between public opinion supervision and judicature in our country. The first chapter mainly introduces the related concepts of public opinion supervision and judicial independence as well as the basic legal basis, so that readers have some understanding of the relevant concepts. Then it introduces the erosion of judicial independence by public opinion in recent years, and reveals the conflict between the judicial organs and the media exclusion system. The second chapter mainly analyzes the causes of the conflict between the supervision of public opinion and the independence of the judiciary, mainly from the root of the basic cause analysis and the deviation existing in the practice of our country two levels of analysis. The third chapter mainly introduces the practice and legislation of dealing with conflicts between supervision of public opinion and independence of judicature in extraterritorial countries under the rule of law, and summarizes and analyzes their practical experiences. The fourth chapter mainly aims at the concrete situation of our country, from three aspects of the legal theory foundation, the basic principle, the concrete measure puts forward the concrete proposal to our country's extant public opinion supervision judicature question.
