【摘要】：社區(qū)矯正試行八年來,我國對社區(qū)矯正的理論研究和實踐探索已取得不少成績,但社區(qū)矯正制度在實踐中也暴露出一些問題:各部門推諉扯肘、工作效率低下、工作人員消極應付甚至借機“尋租”、社區(qū)矯正服刑人員不愿配合等等。而這些又直接或間接與社區(qū)矯正執(zhí)行主體密切相關。 目前我國社區(qū)矯正執(zhí)行主體局限性相當突出,主要體現(xiàn)在:社區(qū)矯正執(zhí)行主體認識不足、社區(qū)矯正執(zhí)行主體權威性欠缺、社區(qū)矯正執(zhí)行主體人員不足、社區(qū)矯正執(zhí)行主體業(yè)務能力欠缺等。究其原因主要表現(xiàn)為——傳統(tǒng)思想和習慣制約、立法滯后、司法所日常工作繁重、社區(qū)矯正工作難度較大等。 為此,本文從社區(qū)矯正執(zhí)行主體的基本理論出發(fā),分析社區(qū)矯正執(zhí)行主體的概念,從宏觀和微觀視角論述我國社區(qū)矯正執(zhí)行主體的爭議;進而對我國社區(qū)矯正執(zhí)行主體的現(xiàn)狀、存在的問題及原因進行分析;隨后考察域外社區(qū)矯正執(zhí)行主體的經(jīng)驗并予以借鑒;最后提出完善我國社區(qū)矯正執(zhí)行主體的四點建議:更新理念,增強主體意識;加大立法,確立主體地位;提高人員素質,加強隊伍建設;引入社會力量,鼓勵多元參與。
[Abstract]:In the eight years since the trial of community correction, many achievements have been made in the theoretical research and practical exploration of community correction in our country. However, some problems have been exposed in the practice of community correction system. Staff passive coping and even take advantage of the opportunity to "rent-seeking", community correction prisoners unwilling to cooperate and so on. These are directly or indirectly related to the subject of community correction. At present, the limitations of the subject of community correction in our country are quite prominent, mainly reflected in: the lack of understanding of the subject of community correction, the lack of authority of the subject of community correction, and the shortage of personnel of the subject of community correction. Community correction of the implementation of the main body of the lack of business capacity. The main reasons are the restriction of traditional thought and habit, the lag of legislation, the heavy daily work of judicial office, the difficulty of community correction and so on. Therefore, starting from the basic theory of the subject of community correction, this paper analyzes the concept of the subject of community correction, discusses the controversy of the subject of community correction in China from the macro and micro perspectives, and then discusses the present situation of the subject of community correction in our country. The existing problems and reasons are analyzed, and then the experience of the external community correction executive body is investigated and used for reference. Finally, four suggestions to improve the implementation subject of community correction in our country are put forward: renewing the concept, strengthening the subject consciousness, increasing the legislation, Establish the status of the main body; improve the quality of personnel, strengthen the building of the ranks; introduce social forces, encourage multiple participation.
