【摘要】：軍事法院的刑事管轄權(quán),是指軍事法院與其他司法機(jī)關(guān)對(duì)直接受理刑事案件權(quán)限上的劃分以及軍事法院系統(tǒng)內(nèi)部對(duì)審判第一審刑事案件權(quán)限上的各種不同分工。具體分為職能管轄、級(jí)別管轄以及地域管轄。軍事法院刑事管轄權(quán)是軍事司法領(lǐng)域中的一個(gè)基礎(chǔ)性問(wèn)題,研究軍事法院刑事管轄權(quán),對(duì)于如何開展軍事審判、進(jìn)行軍事訴訟等活動(dòng)具有一定重要意義。根據(jù)《中華人民共和國(guó)憲法》和《中華人民共和國(guó)人民法院組織法》的有關(guān)規(guī)定,軍事法院是我國(guó)專門人民法院,是軍隊(duì)內(nèi)部行使司法審判權(quán)的審判機(jī)構(gòu),因此它與普通人民法院之間在刑事管轄權(quán)限上必然存在一定程度上的差異。我軍的軍事審判機(jī)關(guān)始建于土地革命戰(zhàn)爭(zhēng)時(shí)期,發(fā)展至今幾經(jīng)易稱。軍事審判機(jī)關(guān)的刑事管轄權(quán),也經(jīng)歷了一個(gè)長(zhǎng)期的演變過(guò)程。當(dāng)前我國(guó)軍事法院與地方人民法院的刑事管轄權(quán)劃分問(wèn)題,尚面臨著一定困境。如,相關(guān)立法不足且存在沖突、軍事法院管轄范圍過(guò)窄以及戰(zhàn)時(shí)、平時(shí)界限劃分不明確等問(wèn)題。分析問(wèn)題的產(chǎn)生原因,如何解決我國(guó)軍事法院刑事管轄面臨的問(wèn)題、研究軍事法院刑事管轄權(quán)的劃分標(biāo)準(zhǔn)及完善劃分方法顯得尤為重要,有助于提升人民法院、人民檢察院以及軍事法院、軍事檢察院受理案件的適法性,也可供進(jìn)行相關(guān)立法活動(dòng)時(shí)作以參考,對(duì)于維護(hù)國(guó)家軍事利益、維護(hù)公民和軍人權(quán)利具有一定意義。 本文試從軍事法院刑事管轄權(quán)的分類與依據(jù)、我國(guó)軍事法院刑事管轄權(quán)劃分面臨的困境及原因等進(jìn)行探析,對(duì)如何完善軍事法院刑事管轄權(quán),提出了依三種模式進(jìn)行劃分,明確了劃分軍事法院刑事管轄權(quán)的五項(xiàng)基本原則,并提出了相應(yīng)的立法建議。
[Abstract]:The criminal jurisdiction of military courts, It refers to the division of jurisdiction between military courts and other judicial organs to directly accept criminal cases, as well as the various different divisions of labor within the system of military courts on the competence to try criminal cases of first instance, which are specifically divided into functional jurisdiction, Level jurisdiction and territorial jurisdiction... The criminal jurisdiction of military courts is a fundamental issue in the field of military justice. The study of the criminal jurisdiction of military courts and the conduct of military trials, According to the Constitution of the people's Republic of China and the Organic Law of the people's Court of the people's Republic of China, the military court is a special people's court of our country. It is a judicial organ within the army that exercises judicial jurisdiction, so there must be some differences in the jurisdiction of criminal jurisdiction between it and the ordinary people's courts. The military judicial organs of our army were built during the Agrarian Revolution War. The criminal jurisdiction of the military judicial organs has also undergone a long evolutionary process. At present, the division of criminal jurisdiction between the military courts and the local people's courts in our country is still facing certain difficulties. For example, Some problems such as insufficient legislation and conflicts, too narrow jurisdiction of military courts and unclear demarcation of peacetime boundaries in wartime, are analyzed, and how to solve the problems faced by the criminal jurisdiction of military courts in China is analyzed. It is particularly important to study the criteria and methods for the division of criminal jurisdiction of military courts, which will help to improve the lawfulness of cases accepted by people's courts, people's procuratorates, military courts, and military procuratorates. It can also be used as a reference for the relevant legislative activities, and has certain significance for safeguarding the national military interests and safeguarding the rights of citizens and military personnel. This paper tries to analyze the classification and basis of the criminal jurisdiction of the military court, the difficulties and reasons of the division of the criminal jurisdiction of the military court in our country, and how to perfect the criminal jurisdiction of the military court, and puts forward three models to divide the criminal jurisdiction of the military court. This paper clarifies five basic principles of dividing the criminal jurisdiction of military court, and puts forward corresponding legislative suggestions.
