【摘要】：量刑規(guī)范化改革推進(jìn)過程中,仍存在基準(zhǔn)刑確立不統(tǒng)一、量刑調(diào)節(jié)方法存在分歧、量刑裁量權(quán)過寬、量刑調(diào)查不充分、量刑說理不細(xì)致等問題。因此,有必要由各省根據(jù)轄區(qū)實(shí)際情況分析確定各罪的量刑基準(zhǔn)點(diǎn),夯實(shí)同罪同罰的根基。同時(shí),應(yīng)構(gòu)建相對(duì)獨(dú)立的、科學(xué)的量刑程序,擴(kuò)大當(dāng)事人參與量刑程序的機(jī)會(huì),推進(jìn)量刑證據(jù)調(diào)查和量刑說理工作,保障量刑結(jié)果的公正、公平。
[Abstract]:In the process of promoting the reform of sentencing standardization, there are still some problems, such as the disunity of the establishment of the standard punishment, the differences in the methods of sentencing adjustment, the wide discretion of sentencing, the inadequate investigation of sentencing, and the lack of careful reasoning on sentencing, etc. It is necessary for each province to analyze and determine the sentencing benchmark points of each crime according to the actual situation of the jurisdiction, and to consolidate the foundation of the same crime and punishment. At the same time, we should build a relatively independent and scientific sentencing procedure and expand the opportunity for the parties to participate in the sentencing procedure. To promote sentencing evidence investigation and sentencing reasoning to ensure the fairness and fairness of sentencing results.
