【摘要】: 清代法律視野下的男風(fēng)現(xiàn)象,究其根本,探討的乃是儒家倫理法思想發(fā)展到了清代,在司法實(shí)踐中對男風(fēng)案的影響。本文由五部分組成,內(nèi)容依次如下: 第一部分,緒論。本部分主要簡析了男風(fēng)、儒家倫理法、清律與比附類推和成案等幾個(gè)關(guān)鍵概念。此外,男風(fēng)案與男風(fēng)現(xiàn)象及律例之間具有的不可分性,男風(fēng)案中的儒家倫理法思想,亦值得注意。 第二部分,清代男風(fēng)現(xiàn)象及其原因。清襲明風(fēng),其社會性愛風(fēng)氣的糜爛,加之社會財(cái)富多年的聚積,以及清政府的“禁妓令”,使得有清一代男色盛行;仡櫱宕郧暗哪酗L(fēng)現(xiàn)象,自先秦及漢的傳世典故,到魏晉南北朝的魏晉風(fēng)流、盛唐兩宋風(fēng)月場上的男色,以及明代的男風(fēng)大熾,清代的男風(fēng)現(xiàn)象與前朝歷代相比,不論是皇室貴族階層,還是官員士人階層、坊間庶民階層,其男風(fēng)因文化、經(jīng)濟(jì)、政治及特殊情境因素等的影響不退反盛。 第三部分,清代男風(fēng)律例及其解讀。清承明制,其律例條文以明律為基,復(fù)經(jīng)幾代修正,使得清代的男風(fēng)律例區(qū)別于明代處于邊緣性性質(zhì)的比附律條而日益完備。相較于宋代簡陋的禁止男娼條例和明代以“比依穢物灌入人口律”為代表的諸多比附律條,清代的男風(fēng)律例頗為詳盡,主要包括了保護(hù)幼童免遭性侵犯和性迫害、維系良賤之間的鴻溝不得逾越、嚴(yán)懲極具惡性的雞奸類犯罪行為、限制男子拒奸殺人擬杖流的適用條件、嚴(yán)本寬濟(jì)地處理洋盜案內(nèi)被脅雞奸者等五類男風(fēng)律例的規(guī)定。 第四部分,清代男風(fēng)案之法律分析。清異于明,政府官員和書坊商人重視刊印案類法律書籍,使得律、例、案三者并行逐漸成為清代司法審判的主要法源。清代法律視野下的男風(fēng)現(xiàn)象因此而展現(xiàn)了其與此前歷朝歷代截然不同的景象——清代司法者既基于清律的規(guī)定對各類男風(fēng)案斷案,亦會比照成案定罪量刑,而不論何類案件,強(qiáng)奸圖奸案、拒奸殺人案、職官有犯案、師徒血親案、暗娼優(yōu)伶案或是洋盜案,儒家倫理法精神均蘊(yùn)于其中。 第五部分,結(jié)論。從殿堂到鄉(xiāng)野,不論尊卑貴賤,總會有耽于此風(fēng)之人的存在、與此風(fēng)相關(guān)之案件的發(fā)生,一味地視而不見已然行不通,法律有對其進(jìn)行規(guī)制的必要。法律雖對此作了詳盡具體的規(guī)制,但是其規(guī)制仍然受限于儒家倫理法思想。
[Abstract]:The phenomenon of masculinity in the legal field of the Qing Dynasty is the root of it, and it explores the influence of the Confucian ethics and law thought on the male style cases in the judicial practice. This paper is composed of five parts, and the contents are as follows:. The first part is introduction.
