【摘要】： 信托制度發(fā)源于英國(guó),它集中體現(xiàn)了英美法理論和司法制度的特點(diǎn)。是英國(guó)獨(dú)特的歷史、文化和司法制度的產(chǎn)物。然而如果沒有可辨識(shí)的、獨(dú)立的財(cái)產(chǎn),也就沒有信托,所以信托財(cái)產(chǎn)處于信托關(guān)系的核心地位。其中,信托財(cái)產(chǎn)的獨(dú)立性是信托財(cái)產(chǎn)的一個(gè)重要特征。信托財(cái)產(chǎn)的獨(dú)立性,是指雖然受托人擁有信托財(cái)產(chǎn)的所有權(quán),但信托財(cái)產(chǎn)要受到信托目的的限制,信托財(cái)產(chǎn)基于信托目的而獨(dú)立存在。信托財(cái)產(chǎn)的地位獨(dú)立于委托人、受托人、受益人三方當(dāng)事人的自有財(cái)產(chǎn),三方當(dāng)事人的債權(quán)人的也無(wú)權(quán)追及追及�；谛磐胸�(cái)產(chǎn)獨(dú)立性的原則建立的一系列完善的信托制度,如財(cái)產(chǎn)制度,信托關(guān)系中三方當(dāng)事人的權(quán)利義務(wù)分配,相關(guān)利害關(guān)系人的權(quán)利保護(hù)等充分發(fā)揮了信托的功能。為了使信托我國(guó)的信托制度的功能得到充分的發(fā)揮,盡快使信托制度融入我國(guó)的法律體系,以及在“信托財(cái)產(chǎn)獨(dú)立性”原則的基礎(chǔ)上盡快完善相關(guān)的信托制度設(shè)計(jì),筆者對(duì)英國(guó)信托財(cái)產(chǎn)獨(dú)立性進(jìn)行了引進(jìn)和介紹性的分析研究,希望能夠?qū)ξ覈?guó)信托法的進(jìn)一步完善有所助益。
[Abstract]:The trust system originated in England. It embodies the characteristics of Anglo-American law theory and judicial system. It is the product of Britain's unique history, culture and judicial system. However, if there is no identifiable, independent property, there will be no trust. The independence of the trust property is an important characteristic of the trust property. The independence of the trust property means that although the trustee owns the ownership of the trust property, However, the trust property must be restricted by the purpose of the trust, and the trust property exists independently on the basis of the purpose of the trust. The status of the trust property is independent of the own property of the trustor, the trustee and the beneficiary. Based on the principle of the independence of trust property, a series of perfect trust systems, such as the property system, the distribution of rights and obligations of the three parties in the trust relationship, In order to give full play to the function of trust system in our country, the trust system can be integrated into our country's legal system as soon as possible. And on the basis of the principle of "independence of trust property", the author makes an introduction and an introductory study on the independence of trust property in Britain. Hope to be able to further improve the trust law in China.
